SSN Married Name Change- K1

Sooo, we just came back from the SS office with a big no-no!

Pre background- arrived on the 29th July on a k1, Married August 29th.

Have not yet applied for AOS.

Have already a SSN from living here in the USA when I was 4-7.

So we went to the SS office today to change my SSN to my married name.

I took my marriage certificate to prove my marriage is why i am changing my name.

I took my passport to prove my identity.

And I took my I-94(Which at first she wouldnt accept as she wanted the card, until i pointed out a number of times that they don't give you that anymore when you enter the country and have to print it out online, eventually she accepted the number at the top of the page)

Anyway I was told this,, She couldnt change my name to my married name on my SSN because i first had to change it with imagination on my legal documents.

when she tried to enter the name on the documents it would only bring up the name i wanted to change it to.

I wanted to change my SSN name now before i apply for AOS.

I don't even know if it's important or not to do so, I was under the impression that in order to get AOS in my married name that my SSN would need to be.

I've read around now that that's probably not the case.

I started looking at old threads and i couldnt find anything past 2011 but found this on this website.

https://secure.ssa.gov/apps10/poms.nsf/lnx/0110205130#b

"NOTE: If the name shown in the NH name field is different than the name shown on the immigration document submitted by the applicant, enter the name shown on the immigration document in the “Other name used by number holder” field on the “Additional info” screen in SSNAP. If the individual has a single name and the immigration document shows FNU (First Name Unknown) or other acronym indicating the person does not have a first name, process the SSN in the applicant’s single name. In addition, enter the acronym (e.g., FNU) in the first name field and the last name shown on the immigration document in the last name field in the “Other name used by number holder” field. For instructions on verifying immigration document with a single name, see RM 10214.110C.1."

Im pretty sure this is what she was trying to do.

Now my question is.

Is she wrong?

Can it be done before AOS?

And is there a point?, should I just apply for AOS in my married name and wait until i have my EAD to get my SSN in my married name?

Sorry fro the rambles!

File for your AOS in the name you want, that will make it easier for SSA to change your SS card name. Once they can look you up in your married name in the USCIS database, it will be easier to get your name changed to your married name on the card. What matters most is you have the SS number, not so much the name on the card. People realize it takes time to get the name change into the system, and its a bit confusing adding the immigration aspect into it.

You should be able to change it with just the marriage certificate, but quite a few have run into problems trying to get their SSN in their married name before they have govt. ID in the married name first.

You do not need it changed to file for AOS. List your SSN on the forms where it asks, and put your maiden name when asks for maiden or other names used. Once you get the EAD/AP in your married name, then go change your SSN, or you could wait for the green card and get the name changed and get the SS card without the 'DHS authorization' notation on it.

As a K1, you are eligible for a SSN in the name on the valid immigration document you present, I-94. So you would be found in the database under your maiden name. You aren't eligible under the reason you had a card before so they deal with current documents and immigration status. When you apply for a get a greencard or EAD in your married name, the USCIS will update the database to new name and new status. Then Social Security will find you in the database, see you are eligible, and mail you a new card in the married name with the old number still assigned to you.

That's the least hassle way for a K1...Get SSN card in entry name. Apply for AOS in married name. Fix name and status later with the SSA. (Social Security Administration)

When you say to file for the AOS in the name that you want, does that mean to file all the AOS-related documents in the name you want as well? E.g., I-693, G325A, I-864, I-785, I-131, etc.

Hi everyone,

I have a quick question. I'm going to change my last name on my SSN as soon as I get my EAD. I found the list of required documents, so my question about our marriage certificate. Will they take it or all I need is just show this certified copy to them?

You just have to show them the certified copy of the marriage certificate, they don't take it away from you.

  • 2 weeks later...

Just wanted to share our experience from this past week. We applied for my wife's SSN name change after we got the EAD/AP card in early April. However we hadn't gotten any response one way or the other. So we finally called the local SSN office and asked what the hold-up was. The worker looked up our name change case, and she realized that it had been already verified by the USCIS. Despite this the SSN office had never moved the case forward and issued the card. So basically it seems like our name change application would have stayed in limbo indefinitely, until we called and asked about the delay.
