You need to be free and able to marry at the time you file. Wait until she's 18, then send it in.

May 2: I-751 received

If she cannot marry at the time you file, then you cannot file. You have to be legally free and able to marry the day you file.

As others have advised...wait for the legal age to file, and at the same time,

since you are young, here are some financial consequences to consider...

1. You have to meet in person at least once in past 2 years for fiancee visa

2. If you want to marry her, you will have to visit her country

3. Overall visa, medical check, shots, paper work, and follow up green card processing could cost $3,000+

4. Wedding and engagement ring...

5. Place to live together

6. Cars to drive

7. Smartphones

Also, you or joint sponsor (if someone is willing) needs to make 125% above the poverty guideline.

I'm not discouraging you, but you may want to understand these facts before you start the

visa processing to help you plan better.

I had no idea they were an essential part of the immigration process...

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

I was thinking the same thing about cars. Guess we're screwed, since we prefer not to own cars and don't drive. ...oh wait. We were approved with no problem! :rolleyes:

(Also: engagement and wedding rings are not necessary for immigration. Neither is a fancy wedding. You really need to reconsider the advice you're giving on the forums, DualityOneness, since it's often flat-out wrong.)

my fiance is 17 and will be turning 18 soon. can i submit the fiance visa 90 before she turns 19? considering it takes about 5 months she wouldnt be receiving it until she turns 18. the state i live in you need to be 18 to marry. without parent consent.

Hi! This Couples story may help you!! They are Dominican but his Fiance is also only 17. Her Mom signed papers to allow her to marry though...

NOTE: Actual sent date unknown due to lawyer negligence - I delivered ALLForms and PAID Lawyer on Nov 7, 2012 - Lawyer kept saying he sent the packet and USCIS must have lost it. When in reality he failed to send the package and only a new copy to USCIS after I made a legal written demand giving him 10 days to perform or return ALL monies paid to him, due to "non-performance".

(IMO it's better to save your money for visits to or from your Fiancé and just fill it out yourself using the K-1 Guide on VJ and Senior Members... They Rock!!!)
