Hi All,

From past few months the world wide F2B category Priority date is ahead of FB1 priority date.

For the same reason there was a law CSPA Opt out provision under section 6, that an FB1 applicant can move to F2B if needed. I mailed NVC and they responded that I need to get approval from DHS / USCIS and need to contact them for conversion.

But when I contact the USCIS, the USCIS executives say that it is not in their scope, and adviced me to contact US Dept of State probably can help. They dont seem to be sure either about the right contact. And USCIS have no email id to which I can send my request in writing.

Since this is something that is new to World wide FB1 category applicants, but common in Phillipines and Mexico, I request someone to share the process how to convert from FB1 to F2B, and details like what email Id we need to mail to request, phone numbers of that department, how much time it may take to complete the process of change from FB1 to F2B etc etc.. :help:

Were you originally petitioned as an F2B? Because I think the opt out is to retain the original F2B category and to not be converted to F1.

I have asked many things in detail that might help you.

I agree, it's really strange... The sudden change of movements, about which category will jump ahead. I was surprise with f1 bec. For the longest time f2b is always ahead in philippines

@apple21: I have few questions will be really helpful if you could help me with them.

1) If my letter reaches the US Counsulate Delhi on Friday 8th Aug 2014, will they change my category to F2B by around 8th Sept 2014 (how much time they will take to effectively be in F2B, like how was your experience and how is the trend for others) ?

2) My PD is already current in F2B ie June 2007, so then will I be sent an Interview letter may be around 10th Sept 2014, since I will be current then ?

3) So If I get the letter in September, then the Interview should be probably in Oct 2014, isnt it ?

Please advice, your responses will be very critical to me !!

Are you done with your consular processing?? You are just couple of months away to being current. If you chose to exercise the opt-out rule with ur case then the whole case of urs would be changed from F1 to F2b. That might bring a delay in ur case in final stage because ur case has been processed under F1 header and all of a sudden NVC has to be informed about ur specific case with a unique identification number gt changed with the category header. If I were at ur situation than I wont risk to expedite mine at the last stage .... I would recommend you to wait for at least 2-3 months to see the further proceedings in Visa Bulletin because you are just fine and will be done in no time, why would you take a risk of delaying by changing category ...

Remember, NVC is heavily backlogged nowadays, your case file is still with them, it might take more than 30 business days for them to review the change in category (provided that USCIS/DHS approved your opt out request).

That's what I tried to explain you G_One, this would be helpful if you are more than 6 months behind the current F1 date but actually you are not. It just a couple of months matter for you to wait in F1. Why to take risk at the last stage??

How much time does it take for approval, once it reaches the Home country USCIS ?

And then after approval, how much time it takes by NVC to effectively change the category to F2B, and trat the case as F2B ?

Can you please share how things happen, the order and the delays, to you or other fillipinos.

Sorry I can no longer give the exact dates as we did opt out way back 2010. All I remember is that it took a month or so for the USCIS at US Embassy Manila to approve the request.

We didn't experience any delay in the process because when my husband filed for opt out his priority date is not yet current. So by the time his F2B PD became current, all is set at NVC and he was already case complete.

IMO, in your case 1-2 months delay or difference in F1 is still somewhat tolerable.

Sorry I can no longer give the exact dates as we did opt out way back 2010. All I remember is that it took a month or so for the USCIS at US Embassy Manila to approve the request.

We didn't experience any delay in the process because when my husband filed for opt out his priority date is not yet current. So by the time his F2B PD became current, all is set at NVC and he was already case complete.

IMO, in your case 1-2 months delay or difference in F1 is still somewhat tolerable.

Things are not loooking good for FB1.. I am just going mad over this ultra slow movement.. :angry:
