Please help!! Ive now been waiting 26months to hear anything from the uscis regarding my application for the I130 visa. My father is a US citizen and applied on my behalf in april 2012! can anybody please suggest who i can talk to about this? all i keep getting is that it could take up to three years, this seems pretty ridiculous to me but may be true. Any advice would be very mucch appreciated. thank you x

Since you are married and over 21, you are not considered immediate relative of a US citizen.

You are under family based category:

  • Third Preference (F3): Married sons and daughters of U.S. citizens, their spouses and their minor children

The Current Priority Date for F3 is 15OCT03.

If your I-130 is filed in April 2012, you have at least another 8-9 years to wait.

of course but there are years of waiting, over 10 years until you can get a visa

so the approval of the i130 can take months or years, it doesn't really matter

once approved it will be sent to the NVC or National Visa Center where it will be stored somewhere until your priority date becomes current. children over 21 aren't immediate relatives and have years of waiting until you can get a visa

Sorry,but are you saying it will take ten years to possibly get a visa or possibly get turned down? X

In about 10 years, you can apply for visas when your Priority Date becomes current. Those visa applications will either be approved or denied based on your and the petitioner's circumstances at that time.

Did your petioner get a receipt that the I-130 was received?

Do you have kids? The longer it takes to approve the I-130 is actually a blessing because of CSPA if you have kids who will turn 21 during the wait for your PD to become current.

I have the reciept number to check my case status but thats all ive recieved in over two years. the case status has been in initial review for almost that long too, just wondering if there is something i should be doing, or is it a case of just waiting? thanks for your info to all who have replied, its very much appreciated, i feel so stuck, my life is on hold right now. Oh Aaron 2020 no i dont have kids, the application was done by my father for myself and my husband.

hi

there is nothing you can do, because there is a 10 year wait, there is no priority for approving the i130.

try to not think of immigration for a long time, focus on your life over there. In case you do have children, they will come as well as derivatives

enjoy life and your husband, be busy and 8 years will go by quickly.

Thank you, thats lovely advice, its so hard when you know where you want to be but just cant get there. thanks again though, maybe il make loads of money and retire early over there instead : )
