Of course. We'll never have the whole picture. But I'd prefer to work with the information we have so far, rather than speculate on what may or may not be the case.

People have jumped on the OP so suddenly and needlessly that maybe we ought to work on answering the questions he's presented, rather than answering the ones he hasn't, so that the information doesn't get lost between the speculation.

Well, you have to be able to prove a valid relationship to someone in order to get a fiance visa and you also must have met them in the past two years and be able to provide documentation of this. So, if you can do that with only having been with someone for two months (I'm gonna assume you weren't having an affair...) and someone it sounds like you haven't met yet, then you've met a lot of the requirements.

Do you mean engaged to the "new friend" for several years? Wouldn't that be rather suspicious if he was married to someone else? After all, he was married for 7 years and only in process of divorcing for 2 months. I agree with whoever made the comment about why the wife might have moved out--maybe she found out about the "new friend" in Denmark. Would be interesting to know when and how he "met" this new friend that he is now ready to marry.

You have to be legally divorced and have the decree absolute in your hands BEFORE you can file for a K1 visa for somebody else... but aside from that there's no definite waiting period after you become a citizen. You were married for seven years so it's not like you just got here yesterday and dumped the wife... Seems like 7 years is a LONG TIME to be married in the US today!

I think the morality police are a little wound up today. The OP merely wanted to know if it would be a problem, applying for a fiancée visa within a short period of time after getting divorced.

You do not need to know his life history and personal details of his relationship to answer this question! That's just being nosey!

The answer is no, it is not a problem, because the USCIS is not meant to apply morality to their decisions, or make biased decisions, like many of you on this thread are doing, especially the women!

As long as he is legally divorced, has a copy of his divorce certificate, proof of a valid and continuing relationship, and proof of having met within the last two years, then the amount of time that has passed since his divorce and filing an I-129F is irrelevant.
