Hi! Our wedding day is June 28 .my i94 will expire on July 24.. I don't have SSN yet .is it OK to get it after the wedding with my new surname .. And is it OK to apply for aos after the July 24.. Thanks

  • Yes, it is okay you applied with your married name. Bring your marriage certificate to SSA office as a proof of legal name change.
  • No problem. You can apply AoS even when your I-94 already expired.

Just to add to what Girl from Celebes said, yes, you can definitely apply in your married name at the SSA office. However, be mindful that you need to have at least 15 days left on your I-94 for them to accept your SSN application. After this period, the next time you can apply is when you receive your EAD/AP card, which takes longer time to be processed (4-6 weeks) as compared to when you apply using your I-94 (<2 weeks processing).

Also, you may encounter some not-so-well-trained SSA employees when they see your married name and run a check on the SAVE database. So there is a big chance that you may be declined using the married name, as what most people here who went this route have reported.

Personally and from what I have read so far as well, it's better to apply in maiden name first, even after the wedding. Then return to SSA after receiving the EAD/AP card to update the last name.

Oh - it's a big problem, on first time applying,

as

K-1 visa holders will get a SSN in the VISA name, as the SSA clerks have to do a lookup in the SAVE database.

If apply in married name, they cannot find the human in the SAVE database,

then

SSA clerk sends out the file for DHS verification - and that takes 1 month or more until the file is returned to that SSA office for further processing.

I suggest NEVER, EVER apply in married name - there is no record of entry in the SAVE database on the married name and it always triggers DHS Verification process - the kiss of death !
