My interview is July 12 I did not change my license because I did not plan to drive in NY and was only going to stay here for 20 months. I did not worry about this until I got my yellow letter yesterday requesting state id. Now is late to get the new one on time so based on prior experiences could someone advise what is best: to attend interview with old license or present a temporary no photo drivers license or Id from NY. You have to surrender your old license that is why I am having this dilemma. I have lease agreement and bank staments to prove the three month residence.

They will likely ask about it if you present an out-of-state licence. In addition, New York state law requires you to obtain a New York state licence as soon as you become a resident of New York state.

You should go and obtain a NY licence tomorrow and hope that it arrives before your interview.

In your current situation you will end up presenting one of these:

-an out of state license

-a temporary NY license

-a brand new NY license with a recent issue date

I think that for any of these, there's a good chance that you'll be asked about proof of residence, so it's good that you have supporting documents ready.

I really don't know if it'll make a difference whether or not you've applied for an NY license since the only requirement is that you show that you have lived in the state for 3 months prior to applying, not that you plan on staying there any longer. Personally, I'd go ahead an apply and go in with a temporary license as well as any other photo ID I have.

Are you sure that they will take your old license? In Texas they just snip the corner so that you're not left without photo identification.

And if it comes up, don't forget to mention that you don't drive in NY.

I'm sure there are lots of people in big cities who don't even have drivers licenses, so I don't think this is going to be a problem... but that's just my guess.

I think you can apply for state ID which is not a driving license. That way you have a state ID for where you live and still keep your license that you currently have..

Thanks for the replies. I ended up requesting the state id today and hopefully I will receive it before the interview. If it doesn't I still have state identification and the proof that the id is in process. Anyway my concern is still there since it comes not so much from proving residence, I have documents to support the three month requirement, but from the fact that you have to change your drivers license within 90 days after you establish residence in NY. Having the id will not solve this but I am hoping it is not a problem I am sure other people have been in this situation and it would be reassuring (or not) to hear their outcomes.
