I-864 - never filed tax returns in the US

Hi All,

I will soon have to prepare the I-864 form. I know that one of the key information they ask for is information on filing tax returns for the last 3 years. I am a citizen through my mother but I was born and brought up in the UK and lived in various other countries, but never the USA so I have never paid taxes in the USA. How do I explain this to USCIS and will they accept?

As USC it doesn't matter WHERE you are in the world you are required to file US taxes if you make over the threshold amount to file.

You will have to back file your taxes. That doesn't mean you will owe any taxes, unless you make over $97k a year, the USA doesn't tax your income again, and you qualify for a foreign exclusion, but you still need to file your taxes.

If you made more than $10,000 in any of the last three years, you are required to file US tax returns for those years.

How do I explain this to USCIS and will they accept?

FYI, USCIS won't be reviewing the I-864, the ultimate decision on whether or not it is accepted will be made by a CO.
