adjustment of status need help please

I petitioned my then fiance last year and we got married here in December.The problem is that his k1 visa expired in february and we haven't sent in his adjustment of status.We are going to at the end of this month.

My question is will we have any trouble with this?and can i use my brother as our sponsor? (my mom was the original joint sponsor)

Filing late should not negatively impact the process. You can use any joint sponsor you wish, provided they are either a US citizen or an LPR.

My i94 expired in October last year, but we only filed for AOS at the end of February this year. We had no problems so far, and yesterday we had the interview and I got approved. Everything went smoothly so far

how was the interview?

It was ok, we had a very friendly IO. The interview took almost 30 mins. She asked about our relationship, how we met initially, where we met for the first time in person, how are we getting along with our inlaws, if we live alone, how's the marriage going, plans for the future; we even talked about our puppy, etc. Very easy!

Mine expired on August and we didn't start AOS until July the next year. I didn't have issues other than getting an RFE for vaccinations which we already expected. As long as y'all got married within 90 days from arrival date, your spouse would be able to adjust status. He is just considered "Out Of Status" but not illegal. Just make sure you apply for AOS as soon as possible.

Correction: We filed AOS on March, not July. I got an RFE for medical exam. I had to get the whole Medical Exam since it has been more than 12 months from when I took my med exam in the Philippines. Other than that, everything went smoothly. I didn't even get an Interview.

Sorry it's been a while (2007-2009) so I forgot some details of my K1 process.
