curious about this topic -

what are the chances of a Russian woman being turned down for a K1/K2 visa, in Moscow, where their is a co sponsor?

also we want to marry - but my situation is odd - I spend 50% of my time in Mexico and 50% in Florida, USA - she visits me in Mexico (because she got turned down twice for a tourist visa) = can we marry in Mexico and apply for DCF in US consulate in Mexico if she has not stayed their for 6 months?

if we marry in Mexico can we file for a CR1?

explanation: It seems the USA, Russian tensions, and the US consulate in Russia are very tough on attractive woman who want to visit the USA, since she was turned down twice for a simple tourist visa, I do not want to take a chance that she will be turned down again on a Fiance visa. We intend to marry and spend the rest of our lives together regardless of USA citizenship or not - we will find a way - we would just like to find a simple way sooner rather than later -

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)

October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

November 10, 2011: Interview - APPROVED!!!

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Tourist visas are denied because the consular officer at the interview feels that the individual is a risk to immigrate. The purpose of a K1 visa is to immigrate. As you are a USC it doesn't matter how much time you spend in or out of the USA. But do understand the limits of the K1. After marriage she must adjust her status. She can apply for advance parole at this time so she can leave the USA without abandoning her AOS. It normally takes from 60-90 days so she cannot leave the USA until that is granted.

K1 is a more expensive process but generally easier as you only have to prove that you have met within the last 2 years, both be free to marry, and both intend to marry with 90 days of the beneficiary arriving in the USA.

CR1 is cheaper but you must prove a genuine bona fide relationship. It takes longer to get, but the beneficiary gets a green card immediately upon arrival to the USA so they can leave the next day if they should wish.

Once the beneficiary has a green card however, they should spend more time in the USA than out of it. If they plan on leaving for a year or longer they can apply for a reentry permit but this does negatively affect the path to citizenship.

K1 is faster to visa

CR1 is faster to green card.

After 2 years as an LPR (90 days less than 2 years actually) the beneficiary can file to remove the conditions on their green card.

After 3 years of being married and an LPR who has spend most of their time in the USA, the beneficiary can then apply for citizenship based off of the marriage to the USC.

Or they can wait until 5 years and apply on their own.

Then finally they can become a citizen... until then they are simply a legal permanent resident.

thank you for posting: I think I understand the differences - I am concerned about her being refused a K1/K2 - however - I understand many people have been approved - I will post K1 questions in appropriate place.

I've been on VJ for many years, and I cannot recall anyone that had a legit relationship being turned down. Of course there have been a few that were asked for more documentation of their relationship, but all of those were approved after the additional evidence was provided. Moscow is really an easy embassy for K-1 or CR-1. They have even been getting easier with the tourist visas, but it will always be harder for a single female to get a tourist visa. Multiple tourist visa denials will have no bearing on the K-1 visa.
