Hi to everyone here! I already got my passport & and my visa packet this afternoon. I was happy that I didn't have to wait for a long time however earlier this morning an incident happened.

Even before my fiancee already told me how "not-so-nice" his ex wife is. My fiancee was her second husband and he said he did everything just to make her happy . Even until the very last day they got divorced, he tried his best to save their marriage. This woman cheated on her, planned everything before she asked for a divorce. My fiancee didn't believe his attorney when he was advised to get a private investigator because his attorney thinks his ex wife has another man. He didn't believe this and was still hoping that he could still save their marriage. And now he has to suffer the consequence for not doing what he was advised. Bottom line: he is paying a huge amount of child support because he has three children with her.

My fiance tries his very best to pay her monthly but it seems the large amount of child support puts him in debt. This ex wife demands more and more. He told me one time that she is a "certificated divorce woman" (sorry for the term) because she also did this to her first husband. She doesn't work but study every possible lawsuit she could file to her ex's to get more money from child support.

To cut it short, my fiancee was ordered to pay 7,300 usd last week and he wasnt aware about this until his attorney called him. He didn't get any mail or what so ever. It seems they had a court meeting w/o him. So he just knew about this when his recently hired attorney called him and told him about the bad news. It was just last week when he got this news. He didn't get that 7300 usd not until today. This morning he went to this place where he needs to pay it. Good thing he was with his father. The people there said, they were ordered to arrest him first before they can accept his payment. The people said they were sorry about what needs to be done and that they know it sound ridiculous but that's what they were ordered to do. So that's what happened, they arrested him for four (4) hours. He said they put him in a diff. cell not with the other criminals. His old father has to wait for him outside for four hours. Then after, they accepted his payment and set him free.This happened while I was sleeping and didn't have any idea about that until he emailed me when I was at work.

I couldn't help but cry because I couldn't believe that he has to experience this. He is a very nice man. His ex wife doesn't care whatever happens to him as long as she could get money (that's her profession)

He told me that its possible to drop this record because it was just a civil arrest but I didn't know what this mean. He will be looking for a defense attorney to see why they have to arrest him before they accepted his payment.

I am sorry if I have to rant this. Until now I feel sorry for my fiancee and as much as I would like to help him. I couldn't do anything but just to pray.

When we were talking about this earlier, he asked me if this would affect the remaining process that we have to do once I'm there in the US specifically the adjustment of status? I told him, I don't have any idea that's why I decided to post this and ask you guys.

My fiancee being arrested earlier due to the reason mentioned above would this affect the remaining process that we have to do like adjustment of status and other stuff?

I am the beneficiary and he is the petitioner. He was the one who was arrested earlier.

The US fiance's arrest won't but the financial impact may. It will could affect your AOS application potentially. After you're married part of the AOS pkg is the sponsor filling out paperwork saying they can continue to financially support you after your arrival. If he has very heavy financial obligations he may need a co-sponsor but really you'll have to fill it out and see what is required.

If the law or their divorce agreement says he has to pay x...and if everyone agreed during divorce proceedings and either didn't or couldn;t fight it then he is obligated to pay what he signed up for. For him to 'all of a sudden' owe $7300 seems odd. Was it because he was behind in his payments? If so that must be remedied. How will he support you and himself on a consistant daily basis if he is behind on his payments now? Go into this with your eyes open.

His recently hired attorney thinks what he is asked to pay is too much and will be working on how to lower it down.

Do they have to look up everything including his child support obligations?

That's an order so even though you don't have it, you have to find wayS to pay it. That's why I feel sorry for him because before they accepted his payment they have to arrest him for four (4) hours.

Things would be affected if YOU were arrested. No need to stress over this.

As long as his income (obviously it is) is above the Federal Poverty Guideline -- this will not impact you're AOS.

They would still base this on the poverty guideline, right?
