AOS from B2 visa - gay marriage

Show what you can now. USCIS understands that newlyweds don't have a lot of evidence. But the instructions also state that you should add in evidence now (on the I-130).

I think besides plane tickets and wedding photos you can provide few more evidence of bona fide marriage. You can have joint bank account, you can have same health insurance as your spouse does (if your spouse health insurance allows to do so ) and your name as in emergency contact on your spouse job. I know its hard to get some evidence specially when you don't have SSN but at least few among those if you can. Good luck.

March 14- Hardcopy of NOA1 for all three applications.
March 21- Received biometrics appointment letter for 04/04/2014
April 2 - Completed Walk in Biometrics appointment successfully. (Original Appointment was for 4th April)
April 9- I-485 Case status has been updated to " Testing & Interview "
April 16- Text and email alert for case update for AOS interview on 22nd May 2014.
April 18- Hardcopy of Interview notice received in mail.
May 22- AOS interview, approved on the spot and got stamp in my passport.
May 27 - Approval notice of I-130 and I-485 in mail.
May 29- Received GC in mail.

03/29/2016: Package delivered.

03/31/2016: cheque cached.

We cant have a joint back account now, they said I need SSN

I cant be added to the lease - I need SSN

so i can show a lot of photos and bills from trips and stuff

would it be enough?

Find a different bank - you are not required to have an SSN, but some bank employees just don't understand that. You shouldn't need one for a lease, either. However, photos and plane tickets are good - although you should be prepared to provide more at the interview, since evidence of financial commingling is very important.

You can also get joint stuff to show at the interview once you get your EAD. Can get SSN with EAD.

But don't worry about this too much. Do what you can, and don't look back.

You are not required to have any evidence.

Worst case, they separate you and ask you about your lives. That's it.

I didn't have a joint bank account during my interview and the officer understand that, as a newlywed, we don't have a lot of evidence. I wasn't even under my spouse's healthcare insurance when we had our interview. We were approved a day after the interview. Don't worry about joint account.

Btw, we're same sex couple as well.

USCIS understand that newly wed couple wouldn't have much evidence. If you don't have much evidence, don't stress yourself over it, apply for AOS and when you have AOS interview you can gather more evidence by then and take with you at the interview. About bank account, you don't need SSN to open a joint bank account, they just don't know it so if you explain your situation you will most likely be able to have joint bank account. About lease, me and my wife asked our apartment official to add my name to lease but as I didn't have SSN, I was told that my name couldn't be added on lease but they would try to see what they could do to solve the problem. I went them to again and again but they said No, they will look into it then I just gave up about joint lease. If I were you I wouldn't worry much about evidence at the time of application as long as your marriage doesn't have red flag. (like big age gap, language barrier and all). But if there is a red flag, I would make sure to include at least one comingling financial document with application. You will be fine. Good Luck.

Thank you so much! The closer we are to send the papers, the more nervous we get.

I guess it's natural. We do have a lot of photos, some plain tickets, some bills. I ope it would be enough for now.

In the leasing office they said that they cant do anything, because a) I dont have SSN number b) Florida doesn't recognize gay marriages, so they can't do anything. We got the same answer in 3 banks and we just gave up.

I do have some questions about the forms. Can you please take a look? It's very few, I'm just not sure about the answers. We tried to call USCIS, but they didn't know or they didn't care enough to answer. Anyway there is a list:

Question 13:
If you are a US citizen complete the following:
a) born in US b) naturalizattion c) parents

My wife was born in Puerto Rico. We are pretty sure we should check a) answer, but I'm very much confused. Did anybody have the same problem?

Part 1 - what does "C/O (in care of)" mean?

Part 3 - Place of last entry into the United States

That's the funny part. I crossed the border in Toronto, Canada and I answered the questions there, before I got into the plane. I landed in Miami, but I didn't go through immigration. Is Miami the correct answer then?

Where you inspected by a US immigration officer?
Means if I answered the questions or the stripped me to my underwear on the back? :D

q16. The category - I guess it's "c9" since I'm a visitor who married US citizen?


FORM G-325A (My wife's)

in the section " This form is submitted in connection with an application for a) naturalization b) status as PR b) other" what did you put?
Since my G325 is simple, because I fill it for PR, what about my wife's?

Born in the US. (Puerto Rico is the US; you should know this if your wife is from there! :P)

The I-130 form is for the USC, so "your" is the USC.

"c/o" is when you don't have an address of your own and you need to "borrow" someone else's address.

Toronto.

It means did you present yourself to an officer. So yes, for you.

C9.

LPR for you. Other for wife. Not a big deal on that.

Were you able to do early walk-in in Biometrics?

It wasn't bad at all! I think it only took 15 to 20 for the interview. We were approved the next day. :)

I didn't go for early biometric, so I'm not sure if they accept early biometric walk-in. It's better to call them to make sure.

Sounds good except, check amount should be 1490 USD (1070+420). I sent two different checks, one of 420 USD on top of I-130, and other one was of 1070 USD on top of I-485. Good luck.
