Both my wife and son received their visa's but the day before they were to travel to Los Angeles my son decided to stay in China. My wife has been here 5 months and now the son wants to join us he is still under 21. Is it as simple as him getting on a plane or is it more difficult now as he is not traveling with his mother?

A..I included my Ukrainian fiance's 18 year son on the I-129f form. My fiancee went for her interview alone on Jan 27th, 1998. She immediately came to the US and we were married on Feb 21st. I called the US Embassy in Warsaw in July and explained that my Stepson was ready for his interview. He had 1 year to come the US on the k-2 visa. They set an appointment for him in 30 days. They mailed him the same forms as they did for my wife. He had to get the same documentation as my wife had to for her interview. As soon as he arrived in the US we applied for his change of status and work card.
(FAQ note: the son moved to the US in Sept 98, and even had the visa interview delayed a month due to problems obtaining an international passport. He was not even required to have a new I-134 affidavit, Although his step dad sent one to him.)

Seems like you're good based on that :) since he already has the K-2. Saw another website

Someone more experienced might have more info.

depends:

1. when does his visa expire? check the date on the visa itself and

2. were 2 visa packets issued? Mom got one, son got one? or was it just one visa packet? if just one visa packet, is high likelihood that HIS visa packet material is already shoved through the door at CBP to USCIS et.al.

If it is expired, I believe he can still pursue a follow-to-join K2 visa, by doing the embassy/visa steps over based on the approved petition.

2/06/13: APPROVED!

yup - you can jumpstart this , this weekend:

1. pay another visa fee at citic bank, get new receipt #

2. email GUZ IV via their webform thingie, tell them you want to redo the K-2, giving over the GUZ #.

they SHOULD clear the flag at ustraveldocs.com/cn within a week, then you'll be able to set up the account again there, then note the receipt #, then self-schedule for another visa interview.

caveats:

1. medical exam must have been within 6 months of future interview date or he needs a new one

2. police clearance certificate has a 1 year validity on it from issue date - so if it's expired, need a new one.

what you need to do is not trivial, but is do-able, contacting GUZ IV and telling them you want a do-over on the K-2 . I think they'll play along, grant this stuff easily, if it's less than 11 months from the visa issuance date on Mom to the new interview date on the son.

[ps - it may be you can set up a totally new account at ustraveldocs.com/cn and put in the new receipt # there, after paying at CITIC. If that's the case, you'll save 4 to 6 weeks of administrative kerfluffle at GUZ IV]

Hi Darnell,

My wife and I have a very similar problem with her son (my stepson). When she applied for her K1 visa, her son did not want to come to America, but has since changed his mind. Her K1 visa was issued on 9/2/2013. Though we listed him as being her son on all her K1 application paperwork, we did not list him as "follow to join". Also, he turned 18 last July, 3 months before we married, so he's not elligible for CSPA protection. What do we need to do to "jump start" his K2? Time is running out for us! Thanks for your help!

Great! Do I send the original D-156 and D-157 that we submitted, or do we fill out new ones specifically for her son?

I sent GUZ the email and they replied with all the information I need except for one thing. Even though the K1 interview can only occur in Guangzhou, can her K2 son interview in another city closer to his home. Shenyang would be perfect. Thanks!

Nice. Hey, I just found some information that is scaring us to death, because we did not list her son on the K1 documents as "follow to join"! Can you comment on this for us?

If the U.S. Citizen and K-1 Parent Marry after the Child Turns 18 – If the U.S. Citizen and K-1 parent do not marry until after the K-2 child turns 18 and the U.S. citizen did not petition for an immigration petition, then the K-2 child will not be able to file for an adjustment of status.
