Hi everybody!

I was wondering if I can get a little help from someone who already filed out I-131. I'm a bit confused. My American fiance and I just got married a few weeks ago (I arrived in the US on a K1 visa) and now we're getting ready to apply for Adjustement of Status. Here;s the thing though, since I dont know exactly how much it'll take in my particular case until I get the Green card (from what I've read it can take anywhere between 3-4 months to years...), I would very much like to have an Advance parole that'd allow me to travel outside the US and get back in because my husband and I would like to spend our honeymoon abroad (we're thinking either Mexico or Europe-in my native country).

Part 7 of the I-131 says something like this:

""On a separate sheet of paper, explain how you qualify for an

Advance Parole Document, and what circumstances warrant
issuance of advance parole. Include copies of any documents
you wish considered. (See instructions.)"
So, given my particular case where I'd just need the AP to have my honeymoon abroad and perhaps visit my family in Europe in a few months (havent seen them for a while now), what exactly should I say on that sheet of paper? I guess I feel like it might be a stupid reason or insufficient, i dont know.. What do you guys think?From your experience, do they give these APs easily?
Any advice/suggestions would be highly appreciated.

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

From the instructions:

(1) A copy of any document issued to you by USCIS showing your present status, if any, in the United States; and

(2) An explanation or other evidence showing the circumstances that warrant issuance of an Advance Parole Document; or

(3) If you are an applicant for adjustment of status, a copy of a USCIS receipt as evidence that you filed the adjustment application;

The underlined part is the important, although it is a little confusing still as you can file concurrently without such a receipt. Basically though you don't need to provide the evidence as you are applying for adjustment of status.

Part 7 asking for an explanation of how you qualify does not pertain to you. Since you are filing the I-485 and you have not accrued unlawful presence, You automatically qualify.

In part 2, check item 1d only.

In part 3, enter an estimated date of departure about 3 months after you file. If you submit the application on July 1, enter October 1.

In part 3, enter length of stay as 2 weeks

In part 4, 1a, enter "visit family"

In part 4, 1b put whatever country you intend to visit

In part 7, check "more than 1"

Do not make any entries under any section other than that required for advance parole. Many I-131s are returned because to many blocks are checked. If you have any questions, feel free to contact me at satximmigration@gmail.com Good luck

Part 4 is not filled out by someone adjusting from a K-1. They would skip from the first section of Part 3 ending at #4c. to Part 7.

OP> You do not need an explanation statement when filing with a pending I-485, as the instructions posted above show. You do not need to state a reason or where you will visit in Part 4 either. If you do not know of a date and length of trip, you can leave those blank and hand-write Unknown after printing out the form, or provide any estimated travel date.
