There is no need to call the embassy, why haven't you read the guides and looked the form instructions yet? All that you seek is in the I130 instructions an the I864 instructions (regarding the financials)

the question for the embassy is if they can recive the I 130 because the USCIS says"

. If you reside outside of the United States where USCIS does not have an international office, you may file at the U.S. Embassy or consulate having jurisdiction over the area where you live only if exceptional circumstances exist and the USCIS Field Office Director with jurisdiction over that location determines that the Embassy or consulate may accept and adjudicate the case."

I just want to be sure if I can or not qualify for this exceptional circumstances.

The main question is: WHY you are NOT reading the instructions and guidelines as other people have already directed you to? Seriously! All the questions you're asking here are in there. Or at least most of it...at least you could save some pain by asking so many redundant questions which are in there. So here's an idea: sit down for longer than 10 minutes, read through the guidelines and THEN if you still have questions, feel free to ask. If you're going to do this whole immigration procedure you need to stand up for yourself a bit more and say, "I want to do this" and read and read and read. It might actually help...Good luck!

4 requirements for the CCA;

1. Have a USC parent, AND

2. Live with the USC parent, AND

3. Be under age 18, AND

4. Be admitted as an LPR.

Tourist visas give them nothing.

You need to get them immigration visas.

The cool part is you can use the waiver for the I-864 which is called the I-864w.

Unfortunately, you will need to count your kids on the I-864 for your wife.

Don't PM. Keep all your questions in your thread. The complete answers may help someone else.

The reason you can use the I-864w for your kids is that the I-864 obligation starts when the beneficiary becomes an LPR and ends when the person becomes a USC. Since your kids under age 18 would automatically become US citizens when they become LPRs under te CCA, the I-864 obligation is moot. Therefore you can file the I-864w for them.

For your wife, she needs an I-864 since she will not be a USC when she becomes an LPR. She will be an LPR. For her I-864, your household count must include all your minor children because that is the rule.

A Joint Sponsor for your wife would not need to I include your kids.

You can also use bank drafts, cashier's checks, certified checks, personal checks , and money orders must be drawn on U.S. financial institutions and payable in U.S. funds.
