Hi everyone, here is an update on what's happened thus far.

My interview was on Aug 13th. Straight forward questions: previous marriages, career back home, any kids and so on, the usual Yes/No questions. All that went well. However the IO said he would review our case as we concurrently filed for AOS while my hubby was still a permanent resident. Therefore they were no immigrant visas available for me at the time. Before our interview, he became a US Citizen and we wrote a letter to USCIS requesting for an upgrade to spouse of a US citizen. Apparently the date we filed the I485 and the category was still key to our approval.

I485 was denied.

I130 and EAD/AP were approved after the interview and I received the card, but it is now invalid since the underlying I485 was denied.

We attended an infopass Sept 2nd and were told an appeal or motion to reconsider would probably be denied also and to just refile a new petition.

I have submitted a new I485 and EAD/AP today and hope for a speedy outcome.

I am sorry for the news about the I485. USCIS shouldn't accept your I485 if your I130 is not current since your husband was still permanent resident ,but they accepted your I485 file and also have interview for you, that's very strange. And you are right the date you filed the I485 is the key reason to the approval. You can file the I130 first but not the I485 if your category is not current. Good luck to you and I am sure you will be fine this time.

i called SS office today. They said they have not proceed anything yet till the immigration update my status in the system.

Then, i called the USCIS regarding my i765 to see if they can help me anything. The lady on the phone told me that i need to make an appointment at the field office. I went through the website to make the appointment as she told me. Unfortunately, that site does not allowed me to make any appointment at all. https://infopass.uscis.gov/

I'm so stuck now. :cry::cry::cry::cry:

Same thing happened to me. I made an infopass (which was easy), i decided to give them a call yesterday and the lady asked for my full name and my SSN reference and after checking on her system she told me to go head and cancel the appointment as my card should be coming within 7 days. I actually went to their office last tuesday and that helped a lot.

My advice is to go by yourself to their office so they know that you're waiting for your SSN

I currently can't make the info pass. I also gave 2 calls to SS office so far, but they kept telling me the same thing that they are unable to process it. I'm not sure if I should give a try to visit the office again. It's been a month already though.

AOS approved today @ Los Angeles. No issues at all. Pretty smooth process from K1 application back in November thru to approval.

I think we were rubber-stamped before the interview as we were called in early and approved and out the door before 9am.

We were missing one form and he gave us the form to file out in the waiting area, then we went back and he told us that he was going to approve it and that we should receive a notice. The interview was on the 4th and we got the notice in the mail today saying "welcome to the United States of America" :) I don't know why he wants to review your case if your application isn't imcomplete...

Thanks.

Interview began with swearing in & showing IDs (Passport &/or driving lic)

questions were very few:

How did we meet?

When was my PoE?

When did we get married?

do we have anything more to submit? (we showed photographs & joint bank stmts)

two yes/no questions from I-485 application (like have you been arrested, have you ever had issues with US immigration)

Overall it was a very great experience as the officer was very jovial & cracking jokes as & when possible..

Good Luck to everyone here
