Hi VJ's! Me and my daughter came to U.S. as k1 and k2. We went to social security unfortunately they only give my ss# and they told us that we need to go or call homeland security to ask authorization so the ss office can give my daughter an ss#. Why? Can u give me any information or advice regarding this matter. Lastly, do I have to file aos also for my daughter or she is automatically an American citizen because her father is a U.S. citizen? Thank you

A K-2 requires an EAD (or green card, or USC) to be able to receive a SSN.

If your daughter's father is a US citizen who was unable to pass on citizenship to her because he lacked the necessary physical presence requirements then she will need a green card before she automatically becomes a US citizen under the Child Citizenship Act; you must file for her AoS if you want this to happen.

Your daughter arrived on a K-2 which means she did not derive US citizenship at birth from her father because the US Embassy can not give a visa to a US citizen.

To automatically get US citizenship for your daughter, she needs to meet the 4 requirements of the Child Citizenship Act;

1. Have a USC parent, AND

2. Live with the USC parent, AND

3. Be under age 18, AND

4. Be admitted to the US as an LPR.

Your child is not an LPR yet. Get your child a green card and then she will be a US citizen.

When your child becomes a USC, you can get an SSN for her.

Meanwhile, you can obtain an ITIN for your daughter for tax matters.

K-1s are allowed to obtain a SSN (with statement on it of not authorized to work) and then the K-1 can get a new card without those words once they have the EAD or GC.

K-2s can not obtain a SSN until they have the GC.

My stepson (former K-2) was able to get a SSN upon presentation of his EAD. He was able to get the "DHS authorization notice" removed from his SSN card upon presentation of his GC at the local SSA office.

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)
