Hi,

I am trying to prepare for NVC, and believe that my husband and I will be able to claim exemption from filing Form I-864, as he lived and worked as an LPR in the U.S. for several years before we moved to Sweden (his work credits added to mine after we were married should reach the required 40 credits). I am wondering if anybody has had any experience with filing this particular form (I-864W)? The link provided to SSA.gov on the I-864 instruction sheet does not seem to work unfortunately, and that would have explained how to go about calculating your work credits and what evidence/documentation to gather. Thanks in advance for any guidance with this!

oops..I used the word, "credits", instead of "quarters". Thanks for pointing that out! It was written on a tired brain ;-) It does not look like I can still edit the post, so I hope my mistake does not put people off from replying (those that have had prior experience with the aforementioned form).

If it wasn't clear, I understand that he needs 40 quarters (I used the word, "credits" by mistake). My intention with the question was more to receive some guidance in the process of filing an I-864W. Thanks!

If he hjas 40 quarters then he would not need sponsorship, does he, your post suggested no.

I don't believe he, alone, would have the 40 quarters, but he can also use quarters from me from the time we were both working in the U.S. after we were married. I need to figure out how to calculate the quarters, and I was under the impression that I needed to get a formal (documented) calculation from an SSA office to submit with the I-864W. So, it's the figuring out how to calculate, and finding out what I can offer for documented evidence that I was hoping someone could offer guidance with. The ssa website does offer some guidance with this, but it looks like you do need to submit something official from the office as well. I finally found a decent website that explains things relatively well for others that might be in the same boat:

I know you can piggyback on your spouses contributions for some things, but you can not as far as I am aware for this. I am sure it can be found with a bit of looking, but logic suggests if it was how it worked, effectively halving the usual 40 for many people, then it would have been mentioned.

It is mentioned. Read the instructions for Form I-864w.

Stop using your logic. It's better to use the rules.

There is no halving anything. The law allows them to combine quarters. They still need a total of 40.

Per the instructions for Form I-864w.

Count your husband's Social Security quarters.

Count your Social Security quarters during the marriage (don't count those quarters when he was receiving a means tested benefit if any).

Add them together. If it's more than 40, use the I-864w.

Oh I hope it's okay to bring up this older thread. This information is exciting to me and I'm wondering if it applies to our situation.

My husband was a green card carrying good citizen in the US for 13 years before we moved to his home country for the past 7. I always worked full time for those 13 years but he didn't. I don't know how many credits or quarters he actually worked but could he qualify for exemption from this form since he lived in the US for 13 years before leaving??? I'm hoping so even though my parents are willing to be joint sponsors for him. I'd rather not, though, if possible. Anyone have words of wisdom for me? Thank you so much!

Thanks. Yes, was finally able to get user id's for both of us on the SS website and printed out both our statements. Looks like we have a total of 65 credits together which should apply for him since we were married during that entire time. I have filled out the I-864 exemption and will mail it soon.
