Timeline

The lawyer represents you in court, You are currently barred from the US the court will understand that, they can't make permission for you to come, Maybe they will want to talk to you on phone during the court probably not. Your lawyer will argue for you and the court will assign whatever punishment . The lawyer will tell you what that is, maybe just a fine or two. Once that is cleared up you will need an immigration lawyer to help you with the waiver of admissibility.

I have another view...

a criminal defense attorney can have the case dismissed on many grounds, in Texas,

and then the court will overturn it's ruling,

and give a 'no-bill' on the arrest,

in effect actually negating the guilty charge at the court (which ICE acted on)

and if all this occurs,

the need for the waiver disappears.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
