Hello, brand new here but I have some questions on the I-134 form. I was in college for the last three years but got a job in December that is above the poverty guidelines. I applied for the visa march 26 and got my noa2 April 22! My fiance and I have been together for three years. She lives in Argentina. I decided to use my father as a cosponsor seeing as my last three years of tax returns don't meet the poverty guidelines. I was able to print off our tax transcript directly from the IRS website but I've read many people have them sent as opposed to printing them off online. My questions are these, am I jeopardizing my chances by having a cosponsor and should I have the transcript sent as opposed to just printing them off the website? I apologize if I'm posting on the wrong place and for not making my timeline yet. Thanks!

Have a copy mailed to you, it doesn't take long. Having a co-sponsor doesn't get you denied for a K-1. Not having proof you can support her and keep her off the public dole will. Accepting a co-sponsor for a K-1 is entirely up to the CO at the embassy that will issue the visa. Look to the regional forums on how Argentina normally reacts to them. If your current income is over the 125% poverty level, you may not need a co-sponsor at all. You just need to prove you're making that much currently and are likely to continue to do so.

You can have the IRS send them to you, you can go to a local office and have them print it for you, or you can print it from online. They are all the same. When they send you your transcript, they are printing from the same PDF file you can find yourself online.

Thanks for the responses! So I looked in the Argentine forum and didn't see anything about a cosponsor hurting my chances but I'm trying to be extra careful because of my job being very resent, only six months.

A cosponsor never hurts your chances unless you need to use one and the embassy never accepts them. Accepting a cosponsor is not required of the embassy with a K-1 visa. It is required they accept one for a CR-1 or other family based visa.

Thanks again for the fast responses! I have another question, I was in school last year and did not work enough to file taxes. I'm going to include a letter explaining why I didn't file taxes and a copy of my transcript from school. I've read also of people filing a tax form with a zero for the amount. I appreciate any insight into this. Thanks!

If you were not legally required to file, then you do not need to go ahead and file just for the affidavit. The statement of why you did not legally have to file is what you need. You can also print off a document from the IRS verifying you did not file, if you wish > http://www.irs.gov/Individuals/Get-Transcript

I am in the same situation as you too. I just finished grad school last October 2013 and started working late November 2013.

So after reading many posts, I reached to a conclusion that most US Consulate preferred current stable income above 125% above poverty level, but some say 100% but I rather used 125% since we have to apply for the I-864 later.

Anyhow, as for the tax transcript, I didn't work for 2 out of the 3 tax years but I am sure it will be okay since we both had a reason, COLLEGE.

It would be a problem if anyone is still unemployed after graduating from college during the final stages of the K-1 Visa process, therefore getting a co-sponsor would help the chances for an approval.

I hope this helps! My fiance interview is coming up pretty soon, May 6th, so wish us luck!!

11-20-2013: I-129F application sent to Dallas Lockbox

11-29-2013: NOA1 received via both text and e-mail. Case sent to California Service Center.

12-05-2013: NOA1 hard copy received

12-09-2013: "Alien registration number assigned" (according to the case status online)

01-09-2014: NOA2, petition approved via online status (41 days after NOA1)

01-13-2014: NOA2 hard copy received

01-29-2014: Fiance received letter in regards to assembling Packet 3 (Seems like the NVC touched and forward the case)

01-31-2014: Received hard copy from Dept. of State/NVC about Packet 3. Case number assigned.

02-26-2014: Took a 2 weeks vacation together with family for our little engagement celebration

03-28-2014: Finally gathered all necessary documents from the beneficiary's end

The legal standard to meet on a K-1 is actually 100% of poverty. But with a K-1, total discretion is given to the embassy to decide if the petitioner can keep the beneficiary from needing government funded support, so they often use the 125% figure, because the AOS requires the 125% level be met. It is best to file a 1040 with even zero income for some embassies, as they will issue a 221g requiring the latest tax statements. Again so much discretion is given to the embassy on K-1s, they can often demand pretty much anything they like.

I went ahead and filed my taxes, better safe than sorry! Thanks again for all the help!

:thumbs: That was my attitude through the process. Take no chances. At the embassy my wife went through, they regularly ignore the no need to file explanations and demand the latest filing.

Thanks Caryh for the heads up! I understand that the legal requirement is 100% but I chose to follow 125% because like you mentioned, they often use that figure :thumbs:

I also filed all my taxes, although I studied abroad for 2 years and I didn't work at the time, I made sure I turned in all my 1040s with zero income. So I am pretty much on top of that too!

So I have all the tax transcripts needed, alongside with my employment/salary verification from my employer and copies of recent paystubs. Looks like I have sufficient amount of proof of financial support (I am going by what the US Consulate in Amsterdam requested on my part).

It is likely that they will accept transcripts. The US Consulate in Guangzhou accepted my tax transcripts. However, at that point of your visa journey, instructions and requirements can often be embassy/consulate-specific, and therefore your question might best be asked at your regional forum.
