Hi

I held a F1 visa since 2008 and got my H1B approved in 2012. I got engaged to a Green card holder in Dec 2012. However my H1B visa stamping at the US Consulate got denied. My fiancee came to India and we got married in August 2013. She got naturalized citizenship in November 2013. She filed for my i130 in Feb2014. The case staus is in initial review.

She is staying in India with me right now. I wish to know from the esteemed community what my options are. My wife wants to go back to the USA and continue with her studies.

Am I eligible for a K3 visa?

Is K3 still being processed? If yes how do i go about it

Could i possibly get a visit visa?

Any information regarding my question will be greatly appreciated.

I-130 and I-129F are combined at the USCIS and adjudicated at the same time. A K3 visa, if issued, may save you a month of processing at the NVC but would cost you twice as much for immigration as a CR1 as you have to adjust your status after arriving in the USA.
