After my first visa I married my fiance and he left after 6 month of our marriege.I never AOS him and I no longer know about his wear abouts. I wanted to know if you guys think i would have any issues if I get into a second k-1 visa? i started dating a guy in November from Santo Domingo and was thinking about filling after july if everything goes well. I know is kind of soon but I wonder where would this lead me....I need advice not negativity please. thank you

Did you get divorced and how long ago ? DR is a high fraud country. it may be harder for you to proof your second relationship is real since you just came off a K-1 process

Biometrics letter received: August 18th

Biometrics appointment: August 29th

Biometrics completed: August 29th

EAD/AP approved: October 3rd

EAD/AP shipped with tracking number: October 9th

EAD/AP received: October 11th

Notice of potential inteview waiver letter received: November 17th

Dated: November 12th

EAD Renewal sent : June 11th

EAD Renewal NOA1 received: June 15th

Welcome letter received: July 2nd Dated: June 26th

First of all, you would need to be legally divorced before filing any new petition. So, you have been "dating" this new guy since November... It is still pretty soon into your relationship to be thinking about taking such a big step. I hope you don't get burned again! Make sure that as you continue to build on your new relationship you continue to build on evidence for your case. I have read cases where people were denied for second petitions and I think this would be difficult to overcome because it is all so recent. As you know, the DR is a high fraud country so it is difficult the first time around, but any subsequent petitions would bring lots of red flags. I would advise you to continue the relationship, see where it takes you, give it time, and collect evidence in case it does work out and you want to go down that path again. Best wishes!

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

THANKS FOR THE ADVICE AZTEC & TAINO... I KNOW IT IS SOON AND I WAS NOT PLANNING TO GO THERE NOW BUT WAS A THOUGHT JUST IN CASE I DICIDE TO DO SO IN A FUTURE. AND BY THE WAY MY DIVORCE IS FINAL!!! THANKS AGAIN.( DONT MIND MY CAP) SORRY...

This is just my personal opinion but I'm in agreement with others that you should give yourself some more time before filing again. As others have stated the DR is a high fraud country and I believe your previous experience with ex-husband will definitely cause red flags. If at all possible wait a little longer before filing again. Only my opinion. Hope everything goes well for you and you make the decision that you feel suits you.

I am the USC and I am aware of the waiver, I am sure the waiver will be granted cause is due to divorce.
