Hello, I am a US citizen and I am engaged to a Vietnamese citizen. We have visited in the last 3 months and are ready to take the next step and file for a k1 visa!

My question is... how are most folks doing this. Attorney, or a service like rapid visa. I am worried about mistakes causing delays. I have seen fees range from $300 - $3,000.

Thanks for any advice, I am excited to get started.

VJ is a do-it-yourself website. Most people here do it all themselves. If your case is uncomplicated and straightforward, then there is not really need to hire a third party. There are many resources here at VJ, such as guides and example forms. You can also ask questions here if you get stuck on something along the way.

If you feel you need a third party, then I would recommend consultations with a few different immigration attorneys to find the one you feel most comfortable with hiring.

As mentioned. If you've got a straightforward case, and can fill out paperwork following the simple guides and suggestions you can find here, no need to pay someone else to fill out and send in the papers for you. Lots of cases in the past that ones used a lawyer and regretted it. Extra delays, high costs for basicly doing nothing, etc.

I recommend you this group of attorney. My fiance and I used it for our process. I got my visa in 5 months. I had my interview last Friday. Even if your case is straightforward, I recommend you this attorney. You would feel more at ease, knowing they are doing a great job. Another important thing about having an attorney is that they can answer your questions and solve your doubts properly. Following strictly what this website says or paying attention to users who know nothing about law, but dare to foretell whether your visa will be deny or not can make your process such a burden. Each case is different and an attorney can help you make the correct choices :)

I recommend you this attorney:

If you dont have hard problem following rules and reading intructions, then dont waste your money.

Save the money for tha adjustement of status and do the process yourself.

My fiance and me did the process ourself, and I was approved in 5 months my petitions.

And my interview was last week and everything was ok.

I used www.easyfiancevisa.com as I did not want to go through the hassle of filing and proof-reading my paperwork. Their fee is around $800.00 and you still have to do the leg work of collecting all your evidence and sending them your personal information. But if you can afford it, you get the peace of mind that it will all be filed properly with no mistakes. They even guarantee visa approval or your money back (sans government fees).

There is nothing that a business that fills out forms for you can do to guarantee a CO approves your visa. That money back statement is merely to make it seem like you need to pay them in order to be sure to get the visa. It is bunk.

Not at all. They make it very clear what their fees cover.

Statistics show that the majority of delays and denials are due to improper paperwork. They guarantee their services are accurate and prompt to ensure no delays and a high chance of approval. Second they are a law office, and also provide legal advice depending on the package bought.

If people want to do it themselves, by all means, they should. But for people like me with the money to get peace of mind that my paperwork is being prepared and filed by professionals with a proven approval rate, why not? Our experience was awesome. We had no worries or headaches wondering if we made any mistakes or missed any submitted evidence. In fact, it was so pleasant we rehired them to do our AOS.

They cannot guarantee a CO approves your visa. It does not matter if the forms are filled out correctly. They have no power over COs in order to guarantee an approval. They could guarantee they will fill out your paperwork correctly and in a timely manner, but the guarantee of of visa approval is purely for marketing and yes, complete bunk.

I do not see any reason why you would pay any amount of money for someone else to do this visa for you. With this website and the other resources on the internet it was not difficult to put the petition together correctly and send it in.

I would only consider an attorney if your case is complicated (divorce, criminal history, unique situations, etc.)

Save yourself the money and just follow the guidelines here, search forum posts and make threads if you are unsure of what to do.

They guarantee approval or money back because 99%+ get approved. The process is fairly simple, a middle school student could do it. If you get denied based off paperwork or evidence then you probably shouldn't be approved anyway.

They can guarantee anything they want, it does not mean one will get the end result of what was guaranteed. Hence, their money back guarantee, which is targeted to give the customer peace of mind.

If the process were so simple, there would not be a need for lawyers, rapidvisa services, or even, dare I say, self-help sites like VJ. :)

Before we started the K1 process, we went to an immigration lawyer and she was nice enough to tell us that we did not need her services and that we could do it ourselves. Saved us 2k and I got my K1 visa in under 6 months. Read the instructions clearly and you'll be fine. I have done AOS, ROC and now my N400 all by myself. It's possible, and yes, VJ is an amazing resource.

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

Thank you, VJ! smile.png
