Form I-693 and DS 3025 needed for AOS

1. Could someone clarify if I need to fill out the form I-693 and submit it with the DS 3025 for the adjustment of status for a K1-visa holder? I'm reading the instructions and it says that although another medical exam is not needed we still need to fill out the form 693. Someone please clarify this for us, please?

2. Are tax transcripts mandatory for the affidavit of support for AOS, it says on the form that it is optional. Kindly help!

Unless there was a specific medical issue you only need to submit the DS-3025, I always suggest to people to attach a copy of page 4 and highlight section 7c relating to K-1 to the copy of the DS-3025

I didn't see the requirement for listing the past three years income with the I-864, everything I read states to include current income information not 3 years past. Can you point that section out to me?

Really? The I-864 form requires you to list your Total Income from your last 3 tax returns, but only to submit the most recent with the form. If you did not file taxes any of those 3 years, then you need to include a statement as to why you were not legally required to file. Current annual income is separate from the Total Income amounts from your past tax returns. See Part 6, #13a - 13c. of the I-864 form, and Page 6, #7 of the I-864 instructions.

Quite interesting. The instructions do not state it is a requirement to include the last 3 years income, nor does it state it as a requirement in the actual INA (reference: http://www.lawandsoftware.com/ina/INA-213A-sec1183a.html ) The only requirement is the most recent tax year.

It DOES say to list the last 3 years income on the form, however, and my guess is that if you leave them blank they would think maybe you didn't file taxes and issue an RFE for a statement why you didn't file.

Do you know of any cases where someone only listed the income of their most recent tax year and it was OK ?

Ya I see it's on the form only, it has been a couple years since I did the I-864 so I guess I forgot about that.... I'll blame it on old timer's disease.... ;)
