I had a question about adjustment of status in a K-1 situation.

I know with a K-1 the intent is to get married and live together.

If the two people get married under a K-1 visa but due to each other's job (when incoming fiance finds a job in the US), each person has/finds a job very far from each other, but the husband and wife have to live very far apart for about 6 months to a year.

Does this have an effect on the adjustment of status process, like if both are interviewed later on?

Or K-1 Visa Journey:


- November 9th, 2013 : Sent I-129f package (FedEx)


- November 15th, 2013: Check was Cashed


- November 15th, 2013: NOA1 e-mail notification (TSC) smile.png


- November 21st, 2013: NOA1 Hard Copy arrived. (Official Notification Date - Nov 14th)


- November 21st, 2013: Alien Registration Number Changed


- February 7th, 2014: NOA2 received by text & email!! (85 days from NOA1 to NOA2) dancin5hr.gif heart.gif


- February 13th, 2014 (14th in Philippines...Happy Valentine's Day Surprise Babe!!rose.gif heart.gif ): I-129F shipped to Dept. of State to receive visa #


- February 14th, 2014: NOA2 hardcopy received.... Happy Valentine's Day!


- February 21st, 2014: NVC assigns visa number. Can now schedule online, interview for fiance at US Embassy


- February 24th, 2014: Now have interview date!! (May 5, 2014 @ 7:30 am)


- February 25th, 2014 (26th in Philippines): Fiance finished medical exam & vaccinations (all in one early & long day) @ St. Luke's & passed


- February 25th, 2014 (26th in Philippines): US Embassy - Manila (USEM) receives our case & is READY for interview


- February 26th, 2014 (26th in Philippines): Able to reschedule for a March 12th interview date! Whoo Hoo!!


- March 12th, 2014 (11th in US): Fiance interviews @ US Embassy....... APPROVED!!! YEA BABE!!idea9dv.gif dancin5hr.gif biggrin.png kicking.gif

Not living together is a red flag, but you get a chance to tell your story. If the story makes sense then it is not a problem.

8/17/10: INTERVIEW DAY (day 123) APPROVED!!

I am kinda in the same situation with you. I have to go to France for working every summer and my wife does not have her driver license yet or get used to live in US by herself. I am about to go to France this May again so my wife will stay at my aunt's house for the summer. I have no idea how that will affect her AOS.

New Journey AOS:

My fiancee came to US on the 8th of March, 2014 under K-1 visa at Newark, NJ Airport for POE.

Applied Social Security Number on the 10 of March, 2014.

Married on the 13th of March, 2014.

Sent I-485, I-765, and I-131 on the 15th of March, 2014.

Received EAD on June 7, 2014.

Received Notice of Potential Interview Waiver on July 1, 2014 date 6/27

Contacted Ombudsman on 01/12/2015.

Ombudsman contacted USCIS on 02/20/2015.

Ombudsman sent a follow up to USCIS on 03/18/2015.

I-485 approved on 03/31/2015 ( we ordered your card).

Welcome notice was mailed on 04/01/2015.

Received Welcome Notice on 04/08/2015.

Card was mailed to me/picked up by USPS on 04/08/2015.

Received GC on 4/10/2015.

I see this as not a problem as long as you have a good reason and can explain yourself should you have an interview. For AOS the main proof is that you are married. You will have more to prove during your removal of conditions (ROC), but anybody committing visa fraud would avoid this situation IMHO. Just document from the date of the marriage until you file your ROC.

Ah ok. I guess Removal of Conditions is more of what I was referring to. I was not exactly sure which one was which. Will not living together because of work affect that?

Yes. It is odd that you expect already to move away from your spouse. The whole point of these visas is to come live with your spouse, not come to the US for work.

In rare cases a couple has to make sacrifices and live apart for the short term, but you are expecting it to go on years.

You will get a chance to tell your story, and if it makes sense, then it is okay. If your story doesn't make sense, or if it seems you are circumventing immigration law, then you will not be approved for AOS or ROC or naturalization.

I don't want to live away but my fiance wants to try to get US experience in her field of work and her current job (in her country) has its main headquarters in US very far from where I am living and working.

I hope to avoid this situation entirely

You will have a chance to tell your story like others have said. But, unless you are in severe financial hardship, I believe that it will be a red flag for your RoC. You have the choice of moving to where she finds a job and finding a job there.
