Hi! I'm new here at the forum and i've found out about this forum when i'm searching for some answers in my questions. :)

my fiancee is in the USA and i'm here at the Philippines. we're in a relationship for more than three years now. we love each other so much regardless of our age gap.

we've filed a K1 fiancè visa application last November 2012. i've got interviewed July 2013. unfortunately it didn't went good because i've been sent to FPU for some questions. i don't know what is the reason why or maybe because of our age gap. i don't know. anyway, we've waited for days, weeks, and months for the feedback from the Embassy but they're not responding. our wedding was orginally dated on August 2013 but due to administrative process, we decided to postponed our special day. out of frustrations of waiting, we emailed the Embassy and they replied that her petition was denied and they're giving back my passports and docs.

last February 2014, we've filed K1 fiancè visa application for the second time.

my questions are:

is there any difference from the 1st to 2nd filing??

is it much faster than before??

is it advisable to file under fiance visa again or is it much better if we get married and file under spouse visa??

any comments, suggestions, and recommendations will be highly appreciated. Thank y'all and Godbless! :)

Why were you denied? You said your interview didn't go good and you were sent to FPU--what is FPU?

I will try to answer your questions from what I know and understand:

  • There would be no difference, and unless you correct why you were denied the first time it would probably happen again.
  • The average processing time according to USCIS is about 5 months. I have heard many success stories here of it taking much shorter time, like 3 months or less.
  • Filing fiancé visa or spousal visa may not make a difference depending on the reason for your denial. You need to fix that part first.

Wow, filed in 2012-- that sucks. I'm sorry to hear you got denied. Anyway, about your question-- if you file for K1 again, it'll be more or less the same process. No, it will not be any faster and you will still have to provide the same documents. I suggest you provide more evidence because what you had was clearly not enough.

Another option would be to just get married and file IR1/CR1 or K3 visa. It will not be any faster than if you file for K1 but at least you wouldn't have to put off getting married contingent on the K1 being issued and you'll be an LPR as soon as you arrive. It shortcuts the AOS process which is also a separate fee. See the visa timelines applicable for either and decide which works best for you. Good luck!

FPU- fraud protection unit

They didn't give me a visa for the reason they weren't satisfied we have bonafide relationship. And my fiancée received a letter from Laguna Niguel USCIS office to notify her the approval visa from the main office had expired and advise her to reapply the K1 visa for me. So she did reapply the petition again and submit same documents and some additional docs and more photos last February 7 ,2014. And after 5 days she already received a priority date of receipt of K1 visa.

I know ..really sucks :-)

We did refile the petition again and as I've said we sent more documents to prove our relationship genuine. My worries are the one who's giving me a hard time on the interview..not the consul but the officer who gives report to US consul. My documents are good and complete as well..so I don't know why they weren't able to issue me a visa last time :-(

Why do you think the CO did not believe your relationship was real? What evidence did you supply? Were there questions asked that you could not answer or the answers did not match the information provided with the I-129F filing and forms? You need to know WHY you were denied and what the issues were the CO saw or you may find yourself denied again for the same reason.

Wait. at your initial interview at the consulate, did they say you were approved AND THEN it was sent to FPU or they didn't say anything but then sent it straight to FPU?

FPU = Fraud Prevention Unit. Not a good place to go!

after i got interviewed by the CO. she told to sit for a while and wait for my name to be call. and by the time i've got called, the person in that window gave me something to fill-up. that's the FPU form.
