I must say, you had an entirely different stance on returning based on a past topic you posted... Before you came on the VWP you were asking questions about being denied and stated you had no intentions of filing for AOS...

No that seems to have changes... Makes me think that this all might have been preconceived? I think your should stick to your stated intent when arriving, to visit family, do your interview then return...

Personally, I would stick to my interview date..

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

Thank you, VJ! smile.png

Life happens things changes. If that was my intentions to begin with, I would never have gone through the entire process to begin with. We had no intentions of staying, but lots of things has changed, and I'm still not sure what to do. I can't fly with two sick kids, My husband won't go back as he got an amazing work opportunity and I got a two week interview notice. Again, I do not post on here to be judged or to get off topic or have people speculating. I am still figuring things out as our dog, belongings, home and bank accounts are still there. It's not exactly black and white. If we didn't have kids it would all be a different scenario. But go ahead and believe what you want a speculate away.

Setting aside the suspicious nature of your whole search for info and sudden circumstances change... Overall, it seems like a huge waste of money and time that you invested in the process...I think you should stick with your original plan and go back... If the kids are us citizens, can they not just stay here? Not to mention that the interview is a a few weeks away, if they have a virus, will it not probably be passed by then? If you decide to AOS, it is a cumbersome process that yo will be starting over from scratch... You will waste a hell of a lot of money as well as not be able to travel for at least 3-4 months, which means more money to wrap up,all the loose ends that you worked so hard to prove were the reasons that you needed to return... If you AOS, you will have to pay someone or inconvenience someone to do a,l that for you... Plus, you will not risk putting your family in jeopardy if say they do prove you did have a preconceived notion to this, abuse of the VWP has consequences which can include a lifetime ban for misrepresentation...
