As long as you can legally marry, you can file for the K1 after divorce. There are no set rules when to file it . I filed 6 months after my divorce was finalized. We had no issue during the process and my fiancee visa was approved recently.

I was wondering if there is any amount of time should wait to file for fiancé visa after divorce. I have been divorced since Dec 5th, 2013. Thanks

All depends on your state and the waiting period after divorce if final. California 6 months some states don't have one. Nebraska 1 year you have to wait to remarry so you would have to wait because you aren't free to marry when you file thats the BIG sticking point so check with your state.

Nope. Both of you need to be free to marry when you file, so you could have filed December 6th if you had wanted.
