Hi, Visa Journey! Please help me. Today we got a CHECKLIST from NVC for our AOS. I don't understand the corrections. Here are they:

(For my husband's I-864 form)
In Part 6. Sponsor's Income and Employment, please correct the following...
[x] Item 13.a. You must include your 2013 tax and income information.
[x] Items 13.a.1. The income you enter must match the total (gross) income reported on your most recent Federal
income tax return. If you filed Form 1040EZ, use the adjusted gross income instead.

(For both my father-in-law's and mother-in-law's I-864A forms)
Part 1 Information on the Household Member
[x] This section is incomplete. Please answer all questions completely. (If N/A, please indicated in the appropriate space).
[x] WXXXXX, PXXXX's income indicated on line 11 of the I-864A does not correspond to that shown on the total income line of the most recent tax return.

I don't understand, we submitted their 2013 W-2s to them, but it seems like they're asking for the 2013 Federal Income Tax Returns. They haven't filed yet, and even if they have already, won't the 2013 ITR's be available AFTER April 2014? My in-laws submitted copies of their ITR's for the most recent tax years, 2012, 2011 and 2010, coz they already have their ITRs for those years. Please help us! Thanks!

Yes they're asking for the income tax returns if you sent the w2, which wasn't necessary. If you had filed the tax transcript would be available as soon as the return is processed, about 2 weeks.

I suggest:

Redo the forms using only 2012, 2011, and 2010 income tax returns.

Make sure all the numbers are correct.

If you have sent your taxes, you can yes, send your entire tax return. But if you haven't they do not need it until April 15th, 2014. Heck you don't have to send the 2013 taxes, even if you've done them, until that time!

Hi, NLR! I wanted to do a direct reply to ur comments, but i cant do it on my phone apparently, so i'll just hope that you read this. We included my hubby's and my in-laws' 2013 W-2s because we thought we needed to include it to correspond with the info they put on the forms (current individual annual income). We didnt know that we're gonna get a Checklist because of that. My hubby only started working just last year, so the only w2 that he has is for 2013. He hasnt filed yet coz he just went back to the US this week; he was here with me in the Philippines for almost 2 months.

He never needed to send W2s, he needed to send either his entire tax return or his tax return transcript. Same with any joint sponsors. Anyone sponsoring also should send proof of their current income in the form of pay stubs and/or a letter from their employer. W2s do not establish current income. If you didn't know you didnt know, but now you do so you can fix it. :) This helps anyone else with this problem as well (since there were a few that posted on here.)

I suggest redoing all the forms and only sending tax information from 2012, 2011, and 2010. Triple check that all the numbers are exactly what is needed. If someone filed a 1040 you use gross (total) income, and if they filed a 1040EZ they use adjusted gross income. So it may vary for each year what they send. Then send pay stubs and/or a letter from employer to prove current income. If the petitioner had zero income they need to write a letter stating why they were not required to file taxes (unemployed, student, etc..)

And just re-do the I-864 right? But I dont have to send my transcripts again?

No you don't, just send the I-864 again once you get the checklist.
