It doesn't work. It is possible to apply, but it takes about 90 days to be approved, and it will expire when the I-94 does. The I-94 is the period of authorized stay the K-1 entrant is given upon entry. Guess how long that time is? 90 days. So, the EAD will expire around the time you actually get it.

Trust us, a K-1 cannot work on entry. But you can minimize the non-working time by marrying soon after entry and filing AOS right away. In the meantime the immigrant can look for work.

Any help would be appreciated regarding my CR1 application for my Filipino wife.

I filed on July 15th, 2013. Got the NOA1 back by July 23rd for my wife. But because USCIS screwed up on transferring my street address correctly for my adopted daughter, I didn't get the NOA1 for her until November. It was stuck at Missouri service center. The Typhoon happened and I asked for an expedited and to have the case moved to Los Angeles (where I live). They moved the case, but to the Texas Service Center. Almost immediately they issued an RFE. They received my RFE on Dec 31st 2013. I called mid Jan to find out what was going on and they said they were still processing. At the end of Jan 2104, they said my file was in security check. I asked why and they told me it could be for finger prints, blah, blah, blah.

I spoke to an immigration attorney last week and he said, "they don't do security checks at this point....unless something is wrong".

I was married once before in June 2011 to a Korean girl who had overstayed her student visa by 10 years. Back then, I was completely unfamiliar with the immigration process. Anyway, we didn't get along and she moved out of my house in Dec of 2011 not telling me where she was going. Nothing. Just basically I don't love you anymore and goodbye. I filed for divorce in Feb of 2012 and it was final in Sept of 2012. I didn't know where to send the divorce decree because I didn't know where she moved to. I recently made an infopass appt in Jan 2014 and spoke to the director in Chatsworth, Ca (suburb of Los Angeles). They told me she hadn't done anything with her 2 year temp green card to change her status. Basically she is in the country illegally now.

I'm just wondering if this is what's holding up my case at the Texas Service Center. Or is it because I got my congressman involved? Or is it just because they are way bogged down with CR1 applications.

The attorney told me to file an i129 K1 and K3 for my wife and adopted daughter. He said I wouldn't have to pay the fee since I've already filed an i130. Should I just go ahead and file the i129? Not sure what to do at this point. This had turned into a nightmare for both me and my wife.

Any help or advice is appreciated. Thanks.
