Good Morning All!

My fiance and I got married on Monday and we are now looking at the next step for my AOS.

I am seeing alot of different things everywhere I read and I am on a bit of a time crunch.

Mr K1 visa expires on May 28th but unfortunately I am bridesmaid at my best friends wedding in London on August 9th. I know I can apply for my ability to work with my AOS forms, but I am also aware that permanent residencey could take a while to be given. I have been reading up on advanced parole but is it possible to to have that for August when my visa epires in May.

Help!! I am totally confused and any adviced will be greatly appreciated.

Hello Karen-- your visa is done. It is for one use and it's no longer valid. The expiration date is only useful to let you know by what date you must enter the US. You've entered so the visa is invalid.

Your K-1 visa was a one-time, one-way visa that was cancelled the moment you entered the US at your POE. Until you receive your conditional Green Card, your immigration status is dependent on your Form I-94. There is no time limit as to when to start the AOS process. Most folks on VJ recommend starting ASAP. At this time, due to protracted AOS (I-485) processing times, it is also recommended that you concurrently file for EAD (I-765) and AP (I-131) with your AOS application. At this time, EAD and AP take about 90 days to process.

If you applied for your AOS along with EAD/AP now, you should have your EAD/AP card the end of May/beginning of June. The EAD/AP typically takes about 90 days to receive. Apply early and you should not have a problem leaving the US for your friend's wedding.

AP is the best way to go, the AP serves as a travel document while your AOS is pending but does not override the requirement for a passport and other requirements. If you read the AP instructions its very helpful.

hank you so much for all your help. Also ust wanted to ask. When I am filling out my I 485 - can I fill it out with my married name as long as I put my maiden name when it asks what name is on my I 94?

Sorry for all the obvious questions. Just want it to be perfect and correct before I send it :-)

Yes you can use married name on all the forms. USCIS will accept your marraige cert as proof of valid name change.
