Hi,

My fiancée (US Citizen) and I (Non US Citizen) are planning to get married this year and I figured I have two options to enter the States. I know that I will come back to my home country with her after the ceremony. I am NOT applying for an AOS as I have work in my home country. Yet we want to apply for a Greencard through a DCF in my home country a few years later. So the two options to enter the States, get married and then return home are as follows:

1. I apply for a K-1 Visa

2. I enter the States with a Tourist Visa

Either one has its advantages and disadvantages that I am already well aware of thanks to books, lawyers and also this fantastic website. My Questions are as follows:

Have you or friends that you know of entered the US on a tourist visa to get married AND returned home after and how difficult was it to pass the boarder? What evidence did they/you show the boarder officials as proof that they/you weren't applying for an AOS?

Any advice or help is much appreciated.

As a German citizen (judging by the flag on your profile), do you need a tourist visa?

It sounds like you should enter as a tourist, get married, then leave. This is perfectly legal and a whole lot cheaper. You should bring ties such as a job with an expected return date, a lease/mortgage, utility bills, car note, etc to show that you MUST return

good luck

All depends on why you are not eligible for the VWP.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”
