Hi guys,

I didn't receive a RFE (My case hasn't been touched yet - Texas Service Center), however I was wondering if I will probably will get an RFE since we didn't state exactly that we intend to MARRY WITHIN 90 DAYS OF MY ARRIVAL. I have seen posts that people say you MUST write WITHIN 90 days. I guess I missed that at the time since I thought that saying that we intend to get married on the K1 Visa is implied. That's how we did the letter:

I have never been married and he is legally divorced and not currently married. I met him in October of 2009 on XXXXXXXXXXXXXXXXX. Since then our relationship has continued to build. He has met my family and I have met his, so everything is set for our wedding once I arrive.

I SWEAR UNDER PENALTY OF PERJURY AND UNDER THE LAWS OF THE UNITED STATES THAT THE ABOVE STATEMENT IS TRUE AND CORRECT.

Yes, it is a must - and as long as the letter has the name of 2 persons and the statement "getting married with 90 days of X's arrival if granted K-1", it is fine. They do not care it is fancy format.

That's the point. I didn't state exactly the 90 DAYS, we both signed and said we intend to get married but we state that we will do once I am there and of course I meant within 90 days, however if I get a picky one getting into my case this person can request the 90 DAYS after arrival deadline sentence. I understand that I should have written this but I guess it would be a little bit too much to get a RFE for such a thing since we both said we intend to get married on a K1-Visa and c'mon, if I don't do it within the 90 days everything would be lost for my AOS and probably I would have to start over or apply for other '' already married '' petition.

I will wait and see what happens tho.

This forum has been super helpful even if it was from 2006. I have a question for all. We are gathering all our K-1 information and getting ready to send it all in. My passport is going to expire in nearly 2 years, so I guess that means it doesn't have the "5 years validity" and my birth certificate is in a safe deposit box in another state that's not nearby. I have is a copy of the first page but not the back of the birth certificate. I made copies of the entire passport and was going to send in that as well as the front page of the birth certificate. (parents' names are on there). Has anyone had a similar situation where you didn't have the exact requirements of these documents? I know I can order another copy of the birth certificate but I don't want to wait any more before sending this petition in. Any recounts are super helpful. Thanks!

Received an email saying we have an RFE. I know it's not the end of the world but I really don't know what it could be for we put everything they asked for in there. I guess we just have to wait and see what they ask for.. Did anyone else receive one this week?

I received our RFE in the mail today and it looks simple enough (I missed a couple of questions on the application) - but what's the best way to mail back the RFE? Overnight with signature? Without signature? I just wanna make sure they get it and it doesn't sit in a P.O. Box for a week.

Any insight is beyond words appreciated. Thanks!! :)

I'd overnight it with a signature just because that's 2 or 3 days closer to getting approved and the piece of mind knowing it got there.

Our case hasn't been touched either but i'm also wondering if we're gonna get an RFE because of the letter of intent.We did write it and we also mentioned the 90 days but we didn't mention which state we're going to get married & they say same sex couples have to do that

Today we've got an RFE... I do not know what it is about. My boyfriend left to England because of serious family issues. So he is not in the country and I do not know when he will come back. I`ve read about RFE and it says that usually USCIS gives to a petitioner around 80 days to reply. Is that correct? Is it always 80 days or it depends on kind of request?
