Checklists:ranting33va.gif

Hi! Got checklists today! Weekend ruined! Have a few questions as I decide how to go about it.

My wife (petitioner) got check list for the following:

Petitioner i-864: You must submit the following financial evidence
[x] A written statement indicating why you did not file ___2012_ Federal income
tax returns.
[x] ______2012_____________________________ IRS tax schedules.
[x] _______2012____________________________ Federal income tax returns, IRS printout, or Letter 1722 issued by
the IRS.
I guess the letter my wife wrote to explain why she hasnt filed (as shes attending college & is dependant on parents) was not clear enough. It did not have exact years mentioned, just that the past 5 years she has been in med school and did not have to file taxes as she is dependant on parents. Her name was clearly mentioned as dependant on father (joint sponsors) 1040 tax return forms which were also sent in AOS.
Joint Sponsor i-864: This is petitioner's father.
[x] Items 13.a.1. The income you enter must match the total (gross) income reported on your most recent Federal
income tax return. If you filed Form 1040EZ, use the adjusted gross income instead.
We attached the joint-sponsors 1040, I did not think that's different from 1040EZ - so we just used adjusted gross income which was $2,000 off from Total Income for the year 2012. 2011 and 2010 were exactly the same. I guess we should use the TOTAL INCOME from this form, right?
There was a single bar-code under everything else, so that means everything else is good in AOS?
---
BENEFICIARY CHECKLIST:
I got a checklist for my visa application! Asking me to submit proof of my eligibility as a Canadian citizenship. I did scan the profile page of my Canadian passport, I guess that's not sufficient? Should I scan it and send it again, or maybe attach my citizenship card as well? health card? I dont know what else..I was born in England & had British birth cert attached, maybe that's why this came up.
When sending documents back (through EP), do we send ONLY the items they have checklisted, it says fill a new i864 form, but do we send the supporting documents with it also? Your tips and guidance will be appreciated.
Thanks for your help.

Petitioner i-864: You must submit the following financial evidence:

I would suggest to prove that your wife was a student. She probably got something at the end of the year for her studant loan. She can add letter that explains in detail.

Joint Sponsor i-864: This is petitioner's father.

I had the same problem. I listed adjusted gross income on my 1040. I had to correct it to the total income on I 864EZ form( which is line 22 on 1040 I think)

BENEFICIARY CHECKLIST:

Is this for Civil documents?

I think passport should be sufficient to prove you have canadian Citizenship but if they asking I would suggest to send a copy of Citizenship certificate as well.

Thanks for your reply.

So, I am mainly concerned with the Petitioner i-864 part of your response. We can write a letter explaining she did not have to file taxes as she was a full time student, provide evidence of her being enrolled overseas, and her father (joint sponsors) 1040 claiming her as dependant, and perhaps receipts for payments made to her university (dont have student loans). I spoke to a friend who's an accountant, he suggested I could also file form 4506-T to receive Verification of Nonfiling. I guess I should do that considering how particular they are being about this.

And yeah, the other checklist is for civil docs, I did scan & send my passport copy, I guess I'll send in a scanned copy of citizenship card also

Only problem with the form 4506T is that it can take up to 10 business days :(

I think you can start process for 4506T and also send the clarification to NVC explaining why your wife did not file taxes. Add evidence of something showing that she is in school. she is also listed as dependent in her fathers tax forms. Highlight SSN and send those. I think they will accept it. Meanwhile if they don't accept it then you might get checklist for 4506T which you can send later.

Thanks. I guess I will go that way then.

Do you know if i should send in the entire AOS with supporting documents in again, or only the i864 and documents specific to checklist?

Here is a draft of what I have wrote, please do weigh in with your advice regarding any changes or additions I should make to this?

REF: Checklist Response; Letter Explaining No Tax Return Filed for 2012 (and 2011, 2010).

To Whom It May Concern:

I, x, am the wife and petitioning sponsor of x. I did not file income tax return for years: 2012, 2011 and 2010 because I have not worked during my 6 year residence in . I am am enrolled as a full time medical student at x. I am expected to complete my five-year program here in March 2014.
I did not work during my time here (2007-present) in order to concentrate on the rigours of medical school. I did not earn an income, nor do I have any other taxable transactions for the aforementioned years.
I was maintained by my father (joint-sponsor) upon his income and savings. Since I made no income of any type for the years in question, I was not required to file income tax return with the Internal Revenue Service.
I am attaching documents listed below to support my claims in this letter, including my father (joint-sponsor) tax returns [Form 1040] which state I am his dependant for years 2012, 2011, 2010.
Please, kindly accept this letter and process our application at your earliest convenience.
Sincerely,
Petitioner
<address>
Attached Supporting Documents:
1. Father & Joint-Sponsors Form 1040 Tax Return listing XXXXXX XXXXX (Petitioner) as DEPENDANT: for 2012, 2011, 2010
2. Bondafide Letter from university confirming enrolment
3. Professional Examination Cards
4. Receipts for tuition fees paid

Do you know if i should send in the entire AOS with supporting documents in again, or only the i864 and documents specific to checklist?

You don't need to send AOS with supporting documents.

You need new I 864 form and the bar coded cover sheet which NVC will send to you.
