As many know already because I've shared it many times, our k1 was denied st the interview on Sep 25. Today I got the following email from uscis. What does it mean? Is it just a standard reply or is there still hope for us

On November 8, 2013, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

If you have questions or concerns about your application or the case status results

listed above, or if you have not received a decision from USCIS within the current

Which service center did it come from ? Look on the letter please. I know you went through CSC but what service center

is written on the letter ?

On November 8, 2013, a USCIS office received this case

The USCIS office that reviews returned casefiles

has received the returned casefile on 8 NOV 2013.

That's all it means.

In a bit, the returned casefile will get reviewed, and then other stuff happens.

I have not seen a CSC reviewed/reaffirmed case here in years for a K1 nor have I heard of an email like that.

They let K1 cases expire.

It may be just a 'standard' BS message or something has changed.

VSC does occasionally review and reaffirm but CSC doesn't. That is why I asked which service center the email came from.

Cases go back to the service center they start out from but you never know what USCIS will do next.

Have you send another petition off in the meantime that could have possibly kicked this response in ?

You can call USCIS and ask for a tier 2 immigration officer and ignore the person answering the phone except to give your

names, DOB, case number.

Ask (the IO/AO) what service center your case is at and tell them you are aware that CSC does not reaffirm K1's but lets them expire

but that you received the email about a review and see what answer you will get.

They usually sit in storage for 6 months and then expire according to an immigration officer I talked to this year.

Marc Ellis also stated that CSC does not reaffirm returned K1's.

I am taking a special interest in this so please keep us up to date here.

If you get a Mickey Mouse answer have your senator make a detailed and not generic inquiry, stressing the fact that CSC does not

reaffirm and if something has changed or if your case is receiving special attention because your CO indeed re validated the case.

PUSH for review and reaffirmation. Rattle their cages.

Thanks for the shout out but truly you have the expert on K1's giving you good tips. Ebunoluwa knows her stuff so follow what she says. And do report back. This I feel is good news. I have noticed they are doing reaffirms for IR1/CR1's much faster so maybe a new thing has happened also for K1's.

Do appreciate TJandJR you sharing such a painful part of your life to us so we can help and all learn together. As I have said before its only a delay. hang in there girl.

Now I have another email that's a case status update saying my i29f petition is in initial review. It was sent the same day theother email was sent.

I don't mean to keep kicking a dead horse but I found this info right here in our own vj so I guess what is happening in my case is pretty normal and standard procedure. And then they let it expire during the review. It went on to say to file a foia to dos and uscis for the co's notes but then many members replied there usually aren't any notes and the real reasons stay in the co's head. Here it is, in part

Kiya's thread on returned petitions is quite old. I read the whole thing way back when, perhaps 7 years ago I don't remember.

A few things have changed since.

The previously (years ago) denial by USCIS used to kick in a fraud marker but they also reviewed and reaffirmed cases.

Then a law suit changed things. CSC from then on allowed returned petitions to expire to avoid a fraud marker for the couple.

In a way it was a step in the right direction to get away from the fraud marker but then it got all stuck in a cow patty.

The reviews CO's think are happening (or pretend to think they are happening) at USCIS are in fact not happening at CSC for K1's.

It usually takes 180 days for a letter to come saying the petition has expired and you are can re file "without prejudice."

The difference in your case is that you are receiving these emails which is new to me.

Therefore I am thinking either some ding dong is sending them being clueless or something has changed again.

So that is why I said to rattle their cages to get a correct answer.

They will not tell you why they no longer do reviews and deny that VSC does do reviews.

At best you will find out yes your case is indeed in review or it is in "review=just sitting in storage for 6 months."

I went all the way up the ladder to the CSC director pointing this out when I threw my fit but with no results other then I can re file.

With all the re shuffling with the service centers perhaps a different center is handling your returned case but not likely.

It is also true that the reasons often remain in the CO's head without hard findings and evidence being on consular notes.

It all goes under the umbrella of "not bona fide" at the misguided discretion of the CO and they do it just because they can.

There is a memo that came out that states a CO may not re adjudicate an approved petition and can't go by assumptions

and speculations or personal bias but proof with hard evidence their findings.

This is not happening as we all know.

We were refused based on a "gut feeling" and that came straight out of the CO's mouth ! She also said didn't "think" our future marriage would be a lasting one and she was not convinced. I asked her why, what is the problem to which she said

"I just have a gut feeling."

Perhaps she ate beans that day and her gut felt funny who knows.

Case was returned and after 180 days USCIS send a letter saying I am free to re file without prejudice.

This all took about 2 years from interview to case closed because of 16 months in AP on top of it.

If I had to do anything different I would have filed a FOIA just to see what came back.

Instead I fought them like a wild benji with letters and senatorial help.

Nothing helped.

No review, no technical denial, just refusal and expiration and free to re file letter. Nice way to maintain the department with more fees.

In your case with the 2 emails I would approach a FOIA with careful thought because IF you DO get a real review versus

"fake storage review i.e. expiration" then a FOIA may or may not drag a reaffirmation out.

I never received any such emails.

I would be calling and sending emails on Monday. Remember only speak with a REAL tire 2 immi officer not a

contractor reading baloney from a script.
