Can someone please tell me what the actual income needed is? I see some people say that some consulates go by the 100% poverty line, and others go by the 125% poverty line. Can someone tell me what the London Embassy goes by? I just want to know for the fiance visa, I understand once it comes time for AOS it is definitely the 125%.

They don't publish an exact amount, but I know of a few who "passed" with less than the 125%. It is a subjective decision by the officer probably based on various things. I would say 100%.

I've heard repeatedly that London greatly prefers the 125% even though "technically" it's 100% for fiance. I don't think I'd risk it if under the 125%.

Were they British and familiar with London? I know there hasn't been repeated preference stated in this UK forum during the last five years. This is what London says about the I-134 http://london.usembassy.gov/faffidavit.html

I can't find it currently, it feels like AGES ago since we started this and I had the info saved (I sent off my I-129F in January). Honestly, it may not have been here on VJ since most of the London/income posts I find are NNs.

The thing folks also need to be aware of is the AOS requirements. It'd stink to get them into the US and then not be able to do AOS.

As everything, it comes down to what feels right for you & yours. We need to be able to do AOS right away and so 125% is a requirement for us. Also, things like tax returns are necessary in our situation because I'm self-employed .. plus, hey, you need it for AOS so it makes sense to have it done already. My transcript took a LONG time to arrive because I've moved since that tax return.

Really get into the nitty gritty of the instructions for the various forms. I know that helped me to better see what was required for my situation. I also feel a huge responsibility to my fiance because I want him to have an easy experience and not feel like we're just eek'ing through the requirements. I'd want him to do the same for me if our situation happened to be reversed!

I agree that barely getting by is not a good plan. Unfortunately, it is a fact of life around here. So many need joint sponsors. And I think I know the website where a woman who didn't even go through London says what London prefers all the time. I don't think they always require 125% but if you are that close, get a different sponsor as a backup. If you have nobody, then 100% has gotten others by. Maybe will work for you. And circumstances also affect decision. The fiancé graduating from med school in December (with 100%) will fare better than the never before employed high school dropout with a new job offering 100%. It is a subjective decision as written in the Foreign Affaires Manual.

I did notice at the interview while I was idling time while the CO typed stuff that they have a table stuck to the wall, it has both 100 and 125% columns vs family size. Who knows why they pick one or the other.

Hey- I was wondering the same thing for the US. I have decent emergency savings but I work part time, and so my decent pay (I'm a cashier). My fiance has savings, much more than me. Do they consider HIS finances too?

If your interview is in London, yes they will. But check it is also enough for the I-864 which has stricter requirements.

Well you have no timeline info so your fiancé could be interviewing in Manila, Juarez, or Paris which have different protocol. Or you may not even doing the K1 process or have a fiancé. . My answer was for a person interviewing For a K1 in London.

Make a timeline and profile to get a good answer.
