I'm trying to help someone out where they paid a lawyer and seems like theyve got ripped off. She has been trying to get a hold of her lawyer with zero call returns and when she walks to his office he's either gone for the day or out of town for the next day or two. This has been going on since May of 2013.

She filed for her husband and 2 children in August of 2012.

The notice that theyve received the application for both kids and husband was in Oct 2012

Her husband got approved in June 2013

Nothing ever changed since then. No approval notice for kids and no interview or anything.

She went to her local congressman's office and filled out the required paperwork for it to be looked into. Was told it will take 5 wks. This was 2 months ago.

Is there anything else she can do in terms of having someone look into the matter for her?

Can I or anyone else speak on her behalf if her English is not good enough?

Did she file 3 separate petitions ? Each immigrant needs their own petition it sounds like only one was filed and that one was approved. She may need to start a petition for the children ( I am assuming the she is a USC and the children aren't hers )

This will not be over quickly. You will not enjoy this.

Well if husband is approved through USCIS his petition is with NVC they need to check there. Since they have a lawyer the lawyer would have got email or notice of case # and process to pay fees and all that.

Your friend needs to start there and ask maybe the kids petition is there also. All she has to do is give the receipt number from USCIS and she will get case# and can login to payment portal and proceed from there.

If they don't have the children petition at NVC yet then she will need to contact USCIS and find out what the issue is.

She can also give notice to NVC that the lawyer is fired and no more contact to them. That is the easy part.

But until they go through NVC no interview is schedule they are hgalf way done.

What is the NVC and USCIS contact numbers where one can actually speak to a live person?

Just before doing anything she should report that stupid lawyer to bbb.org and get her refund back then get help from another attorney or here you can get lots of help. And nvc number is 6033340700 and In case if you want their website to email them its http://travel.state.gov/visa/immigrants/info/info_3177.html oh and if you live in cali the best time to call them is between 3-4 pm. And eastern timewould be 6-7 pm they are open 7-12 am eastern time. And uscis number is 8003755283. Good luck with everything.

Here is the update: There was a misunderstanding due to her lack of english. Her husband was approved in june 2013 and they sent him the package. However, she is not resubmitting the package because she doesn't want her husband to get his visa while there is still zero progress for their children's case.

We called the USCIS and gave the receipt numbers for the children but they only repeat the samething that their application was received in Oct 2012, and that they can't give any other information because the case is with the National Benefit Center - National Benefit Center has no timelines available.

What can we she do now? I told her if she keep withholding her husbands package to move ahead in attempts to wait for her childrens approval then it's possible his case gets hurt in the progress.

Any advice would be appreciated. And if anyone shared a similar experience please do share.
