Outside Normal Processing Times

Hello,

My husband sent in his AOS paperwork in December 2012 and had his biometrics taken in January. We received an RFE in January and responded to it in March. I realize that the RFE may have set back our receipt of his green card, but we sent in an E-request in July due to outside of normal processing times and it was accepted by the system. After not hearing anything, we gave them a call on September 9, 2013. The request was submitted and the woman told my husband to expect a response in 15 days.

Today, we received a letter in the mail that states:

"Based on your request we researched the status of this case. We are actively processing this case. However, we have to perform additional review on this case and this has caused a longer processing time. If you do not receive a decision or other notice of action from us within 6 months of this letter, please contact customer service at the number provided below."

I'm completely baffled by the SIX MONTHS notation. Six months?! It seems like an awfully long time to wait for his green card, regardless of RFE. Even with RFE, that means that we will have waited 14 months for his green card. Has anyone received such a letter and what was the wait time for you? I want to believe that he will receive it before the six month mark, but the time seems crazy long.... When we began this process, I thought he would receive his green card in 6-8 months TOPS. Now we are pushing 10 months (not including the RFE time, which was a 2 month setback) and it might push to 14 months.

Is there anything I can do about it?

Set an InfoPass appointment and see if the officer can get things straightened out. Be pleasantly persistent.

The letter we received that said no interview will be required also said that the USCIS anticipates a 6 month delay in completing our case and to call them after 6 months if we don't hear any thing from them within that time period.

I filed in Dec 2012 adjusting from a K1 visa (no RFE) and got the approval yesterday 09/17. It seems like 9 months is the normal processing time. I'm sure you'll get it soon....

We are still waiting. Our request told us they still dont have our background checks yet., so we have been placed on hold.

I have read that others got the same message, and then got their GC within a few weeks.
