Or you can when you write them. I, btw, wouldn't wait to write them. It takes them 45 days to just look at a request.

Yes, I can write them but I don't know how. Like I said I can't use the online form. The other option is e-mail them; do I have to e-mail them on the address lucybelle mentioned (cisombudsman@hq.dhs.gov) or is there any other address?

12/30/2012: Got engaged.
1/16/2013: Got married in India.

I-130:
2/28/2013: Attorney mailed the I-130 from a U.S. address.
3/4/2013: Priority date, NOA1.
11/6/2013: Case was transferred to Nebraska Service Center.

1/6/2014: 60 days of transfer are up, put in an e-request, given 30 days' time. Contacted the senator. Senator asked to wait till Feb 6 and if nothing then she will do something.
2/5/2014: Website status changed to RFE.
2/10/2014: Attorney gets RFE. They need G325A and photos of both me and husband, original marriage certificate, copy of marriage record and it's translation.
2/15/2014: Mailed the requisite documents to husband.
2/19/2014: Documents received by husband.
2/24/2014: RFE mailed.
2/26/2014: Case status changed to RFE review.
3/6/2014: After 367 days, NOA2.

After approval kept calling NVC but NVC always had one reply, file was not in their system. Husband too called USCIS National Customer Service Center and was told case was sent to NVC.
4/2/2014: Write to NSCFollowup to know about the status of the petition.
4/10/2014: Put in a ?service request with USCIS starting with OVP to locate case.
4/16/2014: Reply from NSCFollowup that the U.S. law prohibited that office from responding to anyone other than the petitioner and to have the petitioner contact them.
4/18/2014: Sent email to NVC Research to locate the case.
4/22/2014: Petitioner sent email to NSCFollowup
5/14/2014: Receive email from NVC Research that they do not have a record of receiving the petition.

Okay Dilmera, i called today. The rep said that you could call, but would need to have your husband on the line to give the verbal authorization for that rep to give you info during that call. If this is something you both can do, it would be good.

The menu options to get a live person are:

1. Press 1, for english

2. Press 1, for case status

3. Press 1, to check status or report a problem with your case

4. Press 1, if you know your reciept #

5. Enter your receipt # (including the letters, like msc would be 672, then continue with the rest of the #

6. Press 1, (after the system repeats the # u entered), to confirm the receipt # u entered is correct

Next, the system will read what is listed on your case status online.

7. Press 3, to report a problem and speak with a cust service representative.

This is where the recordin states: "you must be the applicant, petitioner or attorney of record, or have the applicant present"

I do not know how, but the rep today, said sometimes the applicant can be the petitioner but never the benficiary. He gave an example, but i did not understand it and i called during my morning break, so i did not have time to ask him to elaborate further. (Sorry i cud not be more helpful.)

Now, that you are out of processing time, i hope your atty will do something further? And if not, i hope your husband will go on the line w u. Tell him he just has to give his authorization, by saying, yes. And that u will do all the rest of the talking. Lol :)

Or you could try to use a US based proxy.

I wouldn't know how to do that and would doing that be legal? The idea I get is the ombudsman doesn't want to entertain complaints outside of the US, read complaints not filed by USCs. I think it's just like if you don't belong to the constituency of a senator, he/she won't help you.

hi bad news so for you all that got transferred well i MEAN just me prbly the only dumb stupid woman on this that is getting played with the answers of Nebraska center, I emailed them ON JAN 8th and they practically told me that we have to wait 5 more months because the time starts to count once they receive the case not when the other office did

Seriously?? Or just a tactic to get you off their neck? Some months back congressmen were getting similar e-mails to wait 5 months from the receipt of the e-mail.

Here is how you should respond:

Dear Nebraska Service Center,

According to the press release from the USCIS on October 21, 2013.

"USCIS recently began transferring some casework from the National Benefits Center to the Nebraska, Texas and California Service Centers to balance overall operational workload. The affected casework includes the following form:

Effect on Customers

If your case was transferred, USCIS will send you a notice listing the transfer date and where your case will be processed. Your original receipt number will not change and this will not further delay the processing of your case."

What you are telling me is that the press release that I got, as well as the supplemental letter stating my case would be processed within 60 days were all lies? This certainly constitutes a further delay in my case, if I'm expected to wait a further 5 months. 5 months is the target processing time of the USCIS for a stand-alone I130 case for a spouse. You are telling me that I'm actually expected to wait close to 15 months for you to process my case? The National Average processing time is now 8.9 months, which I am past, and the Processing date at your service center is now March 20. My priority date is March 19. I am therefore outside of normal processing times. You have had my case for 310 days. If my case needed additional processing, you have already had ample time to complete it.

Claiming that my case is under extended review because you have failed to process it in the 10 months you as an agency have had it is unconscionable. I can see in my case update that my case has not even been looked at since ____________. I will be contacting my Congressman and Senators and the Ombudsman, as well as Service Center HQ regarding this. And I will continue to escalate this matter as necessary until you process my case, as you should have done months ago.

I hope that you understand my position on this matter. This is my Husband/Wife and our future life together. You must understand that any further delays are entirely unacceptable, and I will do whatever I have to do to get you to finish processing my case. My Husband/Wife is important. Our lives are important. And I will continue to fight for that.

It's legal as long as you're not stealing it from someone else. :)

I think it's really time for your husband to get on the ball and start pushing for this. You're not in a position where you can fight your own battle here. He's really gotta step up his game here and start pushing for you.

I'm sorry, I know that's not what you want to hear, but he should be working for you. *hugs* I'm so sorry that you're going through this.

Yes, I can write them but I don't know how. Like I said I can't use the online form. The other option is e-mail them; do I have to e-mail them on the address lucybelle mentioned (cisombudsman@hq.dhs.gov) or is there any other address?

No, that's the one you should use. It's just as quick as doing an online submission, at least it seems to be.

They're getting another letter. And it's going to be a nasty one.

If I don't hear anything back from my RFE by Friday I'm going to start pushing again. And I'm sure they'll tell me they have 60 days to respond but whatever. I'm going to get nasty again. My RFE was extremely straight forward and there's no reason it should take longer than 2 weeks to process it.
