I just sent my paperwork for the naturalization, n400. My i751 still pending. I read a lot about the process and only found now that I should sent the GC extension notice. I only sent the copy of my expired greencard as the form instructions and document checklists said. I though that they would know my situation looking at me in whichever database. Did anyone know if my application is gonna be rejected because of that? I though that I could send the missing copy of the GC extension notice. Can I do that or I have to wait to them request it? if they do... I am very frustrated. I expended like a week doing the best application possible and then this. Hope you guys cant tell me something that give me some mind peace. I am very stressed with all this different process. Greetings....

You will probably have to wait for them and see what they will do. I can't tell you if they will reject your file because of the expired green card to be honest. But if they ask you for copy of green card send them a copy of the extension. If you extension is about to expire please make an infopass to get a new extension so you won't be out of status. I sent only GC copy and its has been accepted. So no worries , u will be fine.

03-03-14 -> USCIS received. (Priority Date)
03-09-14 -> NOA1 received.
06-04-14 -> NOA2 received. Approved.
06-18-14 -> NVC Received case.
07-03-14 -> NVC Assigned Case#(Got Case# & IIN Over the Phone).
07-22-14 -> DS-261 Completed.
07-25-14 -> AOS fee Payment.
07-29-14 -> AOS fee shows PAID.
07-30-14 -> AOS Package Sent.
07-31-14 -> AOS Package delivered.
09-15-14 -> IV fee Payment.

I disccused this issue with an officer during a INFOpass appointment.

The officer stated that the fact that they haven't yet approved your 10 year GC does not prevent you from applying to the N400. Officer said that it is not your fault and you are within your legal means to apply.

If you were to ask me personally. I would advise you to wait until you get the 10 year GC approve. It will make everything easier and you will be worrying a lot less.

If you are like me and worry too much for things like this. I would say that it is better to be worried about one thing at a time.

Actually if Ryan had not split this tread from the original, I doubt you would have received any responses--he is just doing his job as a moderator here on VJ.

I would wait and see IF they ask for a copy of the extension letter. Like you state, they have access to your file and can see that you did file for ROC and how long ago that was. You are allowed to file for USC 90 days before the three year mark based on marriage, that is what you did. Most likely you will never see a 10 year GC and go from conditional LRP to USC.

Just relax and enjoy the wait.

How can you go from conditional LPR to USC without the 10 year green card? My understanding is that the I751 has to be approved before or at the same time of the N400, at least that's what the USCIS says in this page...

Right, but a conditional LPR can still file the N-400. The form's qualifications does not distinguish between conditional and non-conditional LPRs. USCIS will be forced to adjudicate both concurrently, and approve the I-751 before approving the N-400.

based on what you're saying seems like I'll have to do both interviews on the same day, and I'm guessing it'll be after 11/13/13 because that's when I'm officially eligible for citizenship

You most likely will not have an interview for ROC. They will just approve it and move on to the N-400 application. You may or may not even see your 10 year GC before you become a USC. So you will briefly be a non-conditional LPR and then a USC. But it will look like you went from conditional LPR to USC as you may not have a 10 year GC yet. Yes, they will approve the ROC and then continue with the N-400. Which happens first is anybodies guess. If the N-400 gets to someone before the ROC, they will see that the ROC is still pending and may have to track down that file and combine the two. If the ROC gets to someone first then it gets approved like any other ROC and there may or may not be an interview. So it really depends on the timing, but either way you will become a USC at the end of the process.

You can have your interview for USC and the civics test before your 3 year anniversary as a LPR, but not the oath ceremony.

Thanks so much ! That gives me some peace of mind! I swear I need a vacation after I'm done with all this USCIS deal, all the money you pay and they still find ways to screw things up !

I have been told by an immigration officer that hurry up and keep requesting my interview for my I751 that is pending. I sent a week and a half ago my N400 and the officer told me that my I751 could delay the process of my N400 and the interview for the I751 have to be done. I don't have any problem with my background checks so, since my I751 file was moved from Vermont to Tampa in June 2013, I think that is a bit ridiculous that I still waiting to get interview. I sent my I751 in October 2, 2012.
