F1 out of status trying to adjust status?

Hi,

First of all, thank you all for the information that you provide to help out newbies like me.

A little bit about my situation; I entered on a student visa and stayed in status for about 4 years before falling out of status. It's been about a year now. I recently got married to my fiancée; about a week ago and am wondering when would be the best time for me to file? Some say right away since am not in status, others say to wait about 3 months so it doesn't raise any flags

Anyone been in this situation? What is the best approach?

Also, since am not in status, I am not able to put stuff like a lease, bills, etc in my name. What should we provide as proof? Is joint bank account and joint insurance enough for now?

Any advice, ideas, etc would VERY much be appreciated

Thanks in advance!

There is no reason to wait to file. Whoever told you that was a 'red flag' is stupid.

Ive been in the same situation like yours.

I was on F1 visa for 3 years until falling out of status. we got married a few months after, which was early 2011 and

we barely filed for AOS this June ( I know, its 2013 alreadyunsure.png ) and we are scheduled for an interview later this month.

My husband always could put me in his health insurance, and joint bank accounts, lease with both of our names, some utility bills. we sent out copies of those along with our child's birth certificate copy.

I've heard that as soon as you get married, file for AOS etc, we did not do it, and it even took a while, but so far my AOS seems being processed as we are just waiting for the interview later this month. (I'm a bit worried what they would ask us for the fact that our filing took so long etc though)

my journey

6/24/2013 sent out i-130,i-485 along with i-765

6/27/2013 NOA 1

7/14/2013 letter for biometrics appointment

7/29/2013 Biometrics

8/18/2013 letter for initial interview appointment

9/03/2013 i-765 approved

9/12/2013 EAD arrived

9/19/2013 initial interview

9/19/2013 i-130 and i-485 approved, card production ordered
