I believe I can file both at the same time.

My husband will be leaving the country soon with a long tour with the US Air Force to Germany. I know that interviews will be required in most cases but I'm not sure where that will take place or what time period do they inform you prior to interview appointment.

I am still an active F-1 student who entered the US with the visa for college.

I planned on visiting him for Christmas but I have found out that if I filed those forms, I may not leave the country and re-enter with F-1 visa? I saw an information that I can acquire Advance Parole. I'm uncertain whether I'm eligible for that.

J-1 student for 2007-2008, F-1 student since 2008 for high school, then full-time undergraduate degree from 2009-present, renewed F1 early on in 2013.

09/23/13 (day 9) Received Hardcopy of receipt for I-485, I-765, and I-131

10/3/13 (day 19) Biometrics given to USCIS

11/27/13 (day 63) Interview Appointment

You would be elligible for AP once you filed AOS. It takes 3+ months to get, so if you want it in time for Christmas, file asap. You MAY be able to expedite AP based on your husband's miltary orders. Check on base, they may have people who can help with the paperwork.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thank you very much for the reply. I was reading the step-by-step guide and thought it was possible to file I-131 (AP) at the same time. But you don't think that's the case, right?

file soon and you wont need to worry about Expedited Advance Parole, but if you do need to Active service is probably a good reason.

I am definitely on it now after reading your post.

Thank you very much for the reply. I was reading the step-by-step guide and thought it was possible to file I-131 (AP) at the same time. But you don't think that's the case, right?

Yes, you can file for it at the same time as you file for AOS, and it is free that way. But filing for it doesn't mean you can travel immediately, you need to get the approval for AP first, and that takes 3+ month currently.

If you file AOS now you should have the AP in time. For active military duty, you can attend your interview alone (that is the only instance when a joint interview is not required).

8/17/10: INTERVIEW DAY (day 123) APPROVED!!

5/23/12: Sent out package
2/06/13: APPROVED!
