Hello, everybody!

I am new here and hope someone can help me with a good advice.

Me and my husband are going to start process for CR-1 visa for me.

During our document preparations we are stuck with one seem unsolvable problem about his financial situation.

The point is that my husband works in his father little business for more than 10 years (actually it was his first and only one job) and all these 10 years his monthly salary is 500 $, he has a small level of OCD and has another 500 $ from government ( which as I know cant be count as an income). He has also no assets, property or saving accounts.

My father-in-law is going to sponsor us. But I read a lot that the consulates and USCIS have the power to look at the bigger picture and decide that I am likely to become a public charge anyway. I read the stories that the consular assumed that father can die and since my husband income is just 6000 a year and he should buy quiet expensive medicine, I will ask for welfare. I tell my father-in-law that he should make my husband salary grow, at least in case not to be refused, but he doesnt believe me - along with my husband and mother-in-law.

P.S. nobody from my husband family (including my husband) didnt read anything about immigration law - no laws, no books and even refuse to read some bad luck stories with denied visas.((

I am in desperation.

Your father in law can be the joint sponsor. Hopefully you can get to citizenship in the next 3 years and not have to worry anymore.

What to do?

Thats not true about CR1/IR1 being refused looking at the "bigger picture". Most consulates look at current and previous years salary. Long as your father-in-law makes the household requirement for the # of folks he supports all should be fine.

they don't have to read law books or anything. You have a joint sponsor so why the stress. And also that information will not be needed at good 6 to 9 months from when you submit your petition. So you have a long wait for that.

I read a few stories when wives were refused even with joined sponsor all because their husbands didn't have at least 10 K a year. and this is my case. of course I am worried. no matter when this information will be needed his salary still will be 500 $ as it always was. It is scary me if on the interview the consulate can ask me how we are going to leave if something happens with my FIL - I know the answer that I will work is not allowed.

You won't be allowed to work? Which city is your husband in ?

Darnell, of course, I will be allowed to work. What I wanted to tell is anyway the consulate looks at US citizen's financial situation, not at immigrant's one
