Well.... she won;t get denied because of the broken hip as such. BUT between her age and her health issues, it is very possible that they will want to see evidence of health insurance (over and above the normal 125% poverty level affadavit). Private health insurance for someone of that age will be very expensive.

The broken hip is not an issue.

Her becoming a public charge is an issue.

At age 85, she is unlikely to work in the US. She will have no health insurance. She will not qualify for means tested benefits for 5 years. The person signing the I-864 will be responsible for reimbursing the government for any means tested benefits she gets.

The first questions that will be asked are "How do you plan to pay for her medical needs?" and "Will you be able to pay for private insurance for an 85 years old woman?"

Private health insurance is very expensive for an 85 years old. If you can find it, you can expect to pay an astronomical rate. (Before anyone brings up Obamacare - it doesn't give out free health care.) This will be the hurdle you need to jump to bring your mother here.

To be frank with you, it is extremely hard to bring over an elderly relative who cannot work and will need very expensive medical attention to the US. For most people, the cost of private insurance makes it impossible.

Thanks for all your advice and responses, I was really adamant about the whole idea but grandkids are coming here soon and they ask if she can come. I told them it is cheaper for all of us to leave her with my brothers and just send money over for her care.

I'm in my early 40s. I am a non-smoker. No health problems. My health insurance is $700 per month.

For a 85 years old woman. You are looking at $3000 to $5000 per month for medical insurance that will not cover 100%.

If you can afford it, then go for it. Otherwise, you are wasting money with a petition and giving everyone and her false hope that she will be living in the US.

Check out the price of health insurance before you file for anything. Most people find the insurance cost alone is prohibitive.
