Hi everyone!!

I was trying to find out about the procedure of getting married after entering the US on K1 visa. But couldn't find anything in particular. What is the legal procedure for getting married in NY state. My fiance stays in Long Island. I am thinking of a traditional Temple wedding & then small party to our friends later on. But want to know what is the procedure to legalize our marriage. Anybody from India who got married under K1 visa can help me? Or whoever having information on legal procedure could also help me. In India, there is a one month notice period involved if you are going for registered marriage. If its a traditional wedding, you just have to fill a form & apply for registration to your local authorities i.e. marriage registrar. Not sure about the procedure in US.My case has been forwarded to NVC & I am waiting for case number.

Marriage requirements vary from state to state. Suggest that you do a simple Google search for "New York state marriage requirements," for details.

You and your partner will need to get a marriage license first - from NYC or your county clerk, depending on where your fiance lives. There is a 24-hour waiting period in New York. So...your license will have a date and a time stamp on it. Your celebrant (judge, holy person, whoever you choose - but they must be LEGALLY able to perform a wedding in New York State) cannot sign your license until 24 hours after the time stamp. So don't plan a wedding until after you've had your license for at least 24 hours (they are good for 60 days). You will then get your marriage certificate (the one with the seal on it - you'll need this later!) mailed to you after your celebrant files the paperwork with the city or county clerk.

Look up the info on Google for his town (if it is not part of Queens or Brooklyn) for the county or city clerk's office.

You and your partner will need to get a marriage license first - from NYC or your county clerk, depending on where your fiance lives. There is a 24-hour waiting period in New York. So...your license will have a date and a time stamp on it. Your celebrant (judge, holy person, whoever you choose - but they must be LEGALLY able to perform a wedding in New York State) cannot sign your license until 24 hours after the time stamp. So don't plan a wedding until after you've had your license for at least 24 hours (they are good for 60 days). You will then get your marriage certificate (the one with the seal on it - you'll need this later!) mailed to you after your celebrant files the paperwork with the city or county clerk.

Look up the info on Google for his town (if it is not part of Queens or Brooklyn) for the county or city clerk's office.

So I need not break my head on this till I arrive in the US because for applying marriage licence we both - me & my fiance have to be present personally while applying. So a now a quick questions to my Indian friends... Before I apply for marriage licence, can I go ahead with traditional temple wedding after entering US on K1 visa??

Contact your local county clerk. You have to follow their procedures.

In the US the religious marriage is all connected with the legal marriage. The marriage license is permission to marry - you need that before your marriage ceremony.

Then you have the wedding you want, so if you want it in a temple, go ahead. The religious leader will then sign your marriage certificate and say that you got married. You can also get religious marriage contracts if that is a normal practice (I don't know for Hindu), and do whatever you want for your marriage. The point is, you got married, so that is good enough for the US.

Then you, or the religious leader, turns in the signed marriage license back to the government, and they will issue a legal marriage certificate showing that you got married.

So you would only have one wedding, the traditional temple wedding, and it would all be integrated with the civil legal aspects of marriage and result in a marriage certificate for NY state.

Government....meaning the local county clerk.
