Hi - My fiancé will be here in 6 days! we are getting married on the 25th and want to Adjust status quickly. Before I get jumped - YES I have read the guides, YES I need more experienced help...because it's just not "clicking" smile.png

1. What are the 3 or 4 forms ( 1-485, I-864, G-325A, I-765??) in order to be able to work, and travel? I know it does not make sense to file for Employment Auth once he arrives, because that expires quickly and it's a waste of money, correct? we do understand AOS can be 3-6 months. i know if you file some together, something is waved...just don’t know what.

2. Medical Question - I don’t see anything in AOS related to the medical portion but often see folks talking about having a civil Surgeon signing some document. is this something he already has in his packet for his POE?

3. I-864 Question - Part 1.a. I am the petitioner. I filed or and filing for the immigration of my relative - is my fiancé considered my 'relative" call me dumb, but I don’t know if this is the correct choice.

Lastly - Where do we send this stuff? I see a DC address, thats it.

Some good, solid help would be more then appreciated smile.png

You will send a big packet with lots of forms. This is the "AOS packet." The main form is the I-485, that is an application for permanent residence.

Actually, have you looked at the forms themselves? Because it says at the top of the form what it is. You file all the forms you listed, plus a few more.

2. If his vaccines are complete and his foreign medical was properly filled out, then he doesn't need to see a CS. If he needs vaccines, then he needs to see one. There is a thread pinned at the top of this forum all about it.

3. When you fill out the I-864, he will no longer be your fiance. You seem to be forgetting you'll be married at that point.

Look over the instructions more. The address is clearly listed in there. It's important to read the instructions enough so that you see all the information there.

thanks. I am askng for help as I have already stated - I have been reading the guides for over a year now. what other forms? how do we know if shots are complete?

I say, print out all the forms, look at them, and practice filling them in. It will become more clear through doing rather than clicking.

maybe I was not clear when I stated i have been over looking this stuff for over a year.... The titles at the top of the forms are irrelevent to me. if i dont know what I need, how exactly would that help?

You don't know what the forms are for when they say right at the top, "Application for employment authorization." The one that says "Application for employment authorization" at the top is an application for employment authorization. That's not irrelevant. That helps you figure it out.

The guide listed has all the forms you need listed. Then the first step is to download them and look at them.

I think you have been looking at this the wrong way for a year, if you didn't actually download the form and look at the title of it.

I am trying to help you help yourself, but you just want to argue and say you did it all when you didn't, so I won't help anymore.

You don't know what the forms are for when they say right at the top, "Application for employment authorization." The one that says "Application for employment authorization" at the top is an application for employment authorization. That's not irrelevant. That helps you figure it out.

The guide listed has all the forms you need listed. Then the first step is to download them and look at them.

I think you have been looking at this the wrong way for a year, if you didn't actually download the form and look at the title of it.

I am trying to help you help yourself, but you just want to argue and say you did it all when you didn't, so I won't help anymore.

Names of forms do not tell me if they are needed or not... thanks for your help. I have been reading the correct information for the past year, I asked for help, not to be ridiculed. Thanks!!!

I am not ridiculing you. I am trying to help you and all you say is "I already did that!"

You can know exactly what is needed by printing off all of the forms listed in the guide. All the ones you need are right there, on that list.

Carie, it actually does make sense to file the employment authorization and AP forms with AOS, as the fee is waived when you file those concurrently. You can expect the EAD (employment authorization) and AP to come in within about 3 months of applying. They are both good for a year from approval. AOS can actually take anywhere from 3 months to a year for approval- it really depends on whether you have an interview or not. For the record, you do not get to decide about the interview, you'll either have one or you won't. Also, If you don't file for your fiance's EAD concurrently, you'll have to wait for his green card to come in, and again, that could take a long time to be approved. I recommend applying concurrently. The form for employment authorization is the I-765, and the I-131 is for AP. The rest of the forms (I-864, I-485, and G-325a) are required for AOS regardless of whether you apply for EAD/AP or not. Also, the G-1145 form is optional, but if you want text or email notifications letting you know when the USCIS receives your forms, processes them, etc., I recommend filling it out.

As for the medical, your fiance should have gotten a medical exam before the interview. As stated above, as long as he has all of his vaccinations and the medical was completed and signed appropriately, you should be fine. As for the I-864, your husband is your relative.

One more recommendation. You said you're filing very soon after your fiance gets here. You will need to submit a certified copy of your marriage certificate, and in some states, that can take a week to be available. So if you're getting married on the 25th, it may be early September before you can obtain that certificate, but you definitely need it for AOS.

Actually you missed the I-131 in your 1st post as well. Not sure what is confusing you. You need what the guide states, I-485 which is the application to adjust status, the I-864 which is the required affidavit of support, the I-765, which is for employment (EAD), the I-131, which is for re-entry when traveling(AP), and the G-1145, which is to receive e-notifications of your files being received.

Each form also takes supporting documentation to go along with it. You need to download the form instructions along with the forms in order to make sure you know each thing that is required for each form,

Hi sis i sent ths vaccination rec sheet along with aos..make sure he has it :) if he doesnt have it thn tell him to go bak to his dr nd ask him for new1:)

I-693 form, medical examination of aliens seeking adjustment

my hubs personally had to visit a civil surgeon as he needed a second series of shots, after that the civil surgeon filled out paperwork and gave us a sealed envelope to send to chicago lock box

first you need to make a cover page with your contact information, description of the benefit being filed for, and a table of contents of what is included in the packet.

a complete copy of his passport (biographical page as well as entry stamps)

copy of the K-1 visa from passport

copy of the valid I-94 (front and back copies)

copy of his birth certificate with english translation if that applies

two passport photos of him

if you fill out the G-1145 form it has to be attached on top of the cover page

after packet is accepted, you will get a confirmation either via email or text, or mail, then you will get a letter telling you the date and time for his biometrics appt, he will be fingerprinted and photographed, you need your appt letter and NOA2 letter to get into the appt.

we filed AOS 4/19/13 and got our NOA letter 4/30/13, biometrics done 5/24/13, we were approved for work and travel 6/21/13 and received his card 6/29/13

as of last weekend we got a letter stating we probably won't have to have an interview but processing his green card would take another 6 months

my advice is always to print the forms, read the instructions, when done, read them again, and when you think you got it, read them again. always use blue or black ink or type the forms on computer then print, triple check your package before sending, breathe, pray and have faith.
