We finally have my wife's marriage based AOS interview. The generic letter states if you had any criminal arrests or even if it was expunged, to bring it to the interview. I had one DUI over 10 years ago, which I believe is no longer in the system. I have been clean since that one incident. When filing I-129F for the K1 VISA, it only asks if you have criminal history/arrest for violence, drugs, etc..... Within 3 years. Am I really going to have to bring court records for an old nonviolent or drug related DUI. According to the I-129F it was not required. Anyone who knows or has been through an interview with something like what I had over 10 years ago , please let me know. Thanks.

This is your wife's AOS, not yours. That point on the letter relates to her so they won't mind of your past DUI.

If you look more at the letter, it is addressed to her so each time they say "you", it's about her.

Anyone, correct me if I'm wrong. :)

K-1 Visa Timeline AOS Timeline

- Aug 31st, 2011 - Mailed I-129F package - May 29th, 2012 - Mailed AOS/EAD/AP package

- Apr 13th, 2012 - Visa received - Aug 24th, 2012 - Green Card received

ROC Timeline

- May 19th, 2014 - Mailed ROC package to CSC

- Aug 8th, 2014 - Green Card received

N-400 Timeline

- Dec 29th, 2021 - Filed online. Got notice that biometrics will be reused.

- Now waiting...

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I have been there and done this. I would only offer that, if you are concerned, you might want to go to your local city/county/state law enforcement office and get an "official" criminal history report and include a copy of this . From my personal experience, your history will not be a problem.

The letter is to her c/o me, so it really pertains to her and I will just leave it alone. They didn't have an issue approving her K1 VISA and EAD. If they want it then I can go an get it. Since it is so old and was not a felony, it may already be out of the system. Thanks.
