Hello VJ friends please my wife submited our Petition I-130 this month, please i want to apply for a visit in novermber, i want to celebrate her birthday and my own birthday with here in the USA please i want to know if it will affect our petition and what is the chance of me getting the visa.

please i need you guys contribution as much as u can contribut to us

i know there are some who needs this help too and will go along way for us

If you do not already have a tourist visa to enter the US, I doubt that you can get one now with the I-130 in process. Applying for a non-immigrant visa while you obviously have immigrant intent (by virtue of your I-130 filing) will most likely be construed as visa fraud.

If you already have the I-130 petition in process, they will not give you a tourist visa. They state that it is assumed you wish to go to the U.S. and there fore you must wait on the original petition. They assume that is you could get a tourist visa you would stay and not return to your home country.

Also it was explained to me by others that even IF you could get a tourist visa yu would not want to do anything to cause issues for your I-130.

A visitor visa will not affect an I-130 in any way, as long as you do not overstay and incur a ban.

However, as stated, it is very difficult to get a visitor visa after being married to a USC. Significant proof of ties to your home country should be provided if you want to even try.

Getting a tourist visa from Ukraine is difficult. More so when you have an I-130 in process as you have a wife here and have declared intent to immigrate. It is going to be pretty hard to show solid ties to Ukraine when you have already indicated you are intending to leave.

At any rate...nothing ventured, nothing gained and it will have NO impact on the I-130 one way or another

Be advised that even IF you already have a tourist visa, the decision to allow you to enter the US is that of the CBP officer at the POE. He swipes your passport and sees you are the beneficiary of an I-130 and he may just say..."turn around and take the next plane back to Ukraine"

If you already have a tourist visa then you need to bring signifigant evidence you will return WITH you when you enter the USA
