Hi Can anyone help us, after a long 5 1/2 month wait and our file being transferred to Texas (June 21 2013) we recieved our case was updated with the following

Request for Evidence

On August 5, 2013, we mailed a notice requesting initial evidence in this case. Please follow the instructions on the notice to submit the evidence requested. Meanwhile, processing of this case ..................etc etc

As my American fiancee is working in Europe for the next 3 weeks and has no access to his mail at home, he called USCIS (a 3 hour wait to speak to a tier 2) and was told he has to wait to check his mail when he returns to the US and they could not furnish him with any information over the phone.

My questions if anyone can help are:

1. Is this an RFE?

2. if so how long will this delay our case?

3. We have a senator who may be helping with our case, could he get the information from USCIS over the phone and advise us of what they need?

4. typically what further information is required in a RFE? We were certain we had been included everything and more that was required

any help is appreciated

Yes, it is an RFE..Delays on the case will depend on how fast you can comply what they are asking.

Basically, they will not tell you what are they asking..You have to wait for the hard copy to find out..

1. Is this an RFE? Yes

2. if so how long will this delay our case? depends, as much as 10 days or 6 months or longer

3. We have a senator who may be helping with our case, could he get the information from USCIS over the phone and advise us of what they need? Maybe or maybe not. You have nothing to lose by getting your senator/congressman involved.

4. typically what further information is required in a RFE? We were certain we had been included everything and more that was required Typically, an RFE is very specific about needed additional information requested.

Sorry to read this, you are going to have to follow the instructions for the RFE.

Is there any way that a member of your fiance's family can get to his mail? It's just that you have to respond to an RFE within a certain timeframe (I tied to check but couldn't find the number of days - offhand, I thunk it's either 45 or 60 days). It's just that if it takes a while to compile the extra evidence, it will not be great if you've lost a couple of weeks of that time. If it's something simple like missing 'letters if intent', then that will be fine.

thank you all so much for replying, it has been a huge help, in this constant nightmare of a visa process.

I do believe you are right Anna I think it is 30 days we have to respond, we are going to get a realative of Jason's to check and email us a copy if it was there, we are kindof hoping it will be there today, as we were notified by email on monday 5 August and our file is in texas and Jason lives in Houston texas so fingers crossed it left in the mail on Monday and it should be at his house and we can find out what they require from us.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

We have managed to find out what the Rfe is for, my American fiancée only sent the last page of his divorce papers and they are looking for his final absolute divorce decree!, he is arranged for the 40 page document to be sent here for me to look for the page! Has anyone any idea what they are looking for? Jason suggested we send the whole 40

Pages to them?

In the uk my one was accepted as it is a one page document which is red stamped from the court

Any help would be great
