Hi,

I am brand new to this forum and I was wondering if someone could point me in the right direction. My father was recently granted full US citizenship. My father was granted his citizenship late in life. He is in his mid 70's and was able to get his US citizenship due to the fact that his mother was a US citizen.

My parents intend to move to the US to finish out their retirement years and are currently in the process of relocating. They should be set up in the US within the next 12 months.

Here are my questions:

1. As a son of a US citizen what options for sponsorship do I have available to me?

2. Do I need to wait until my father is living in the US before I can file anything?

3. What is the first thing I need to do?

Any help would be greatly appreciated!

He could file on Monday.

Thanks Darnell for the quick responses. There is the possibility that he may delay his relocation to the US for awhile. Do you know that if he holds a valid US citizenship but decides to stay in Canada, can he still sponsor me?

He must prove domicile when you are about to become current.

Dad can file for you based on his US citizenship.

If you are unmarried and under 21, then it's about a year to get an immigrant visa.

If you are unmarried and over 21, then it's a 7 years wait for a visa.

If you are married, then it's 12 years.

When its time for you to immigrate, your father must have a US domicile. He does not need it to file the I-130 to start the process.

Ah - thanks for the reminder, aaron.

OP - although your Dad could file the I-130 now (to lock the time and clock)

he has to prove up domicile at NVC, in the I-864 submittal into NVC.

Since you are not in a preferential category, yer going to have a longish wait.

So, IMO, file now.

When doc intake finally starts at NVC, years down the road - he will be in the USA by then, so this 1 year you are speaking of, for him to move into the USA, won't matter.

So, it'll roll like this:

1. file I-130

2. wait until case becomes current / visa number available.

3. doc intake into NVC

and so forth..

What is he going to do about Medical Insurance, he will not get Medicare which most OAP's use.
